Stop Foreclosure: Get the Lender to Waive the Deficiency Recourse!

Denver, CO – We had received an email from another Real Estate Broker, Dean, from the Colorado Springs area, and he had a very good question about deficiencies. Here is Dean's question.

“"I have a very sensitive situation with a couple that will have a job transfer out of state, and we were concerned about the short pay-off deficiency. Will Bank of America approve this with NO recourse for the deficiency debt?, Dean.”

A Quick Note: The reason he is asking this question is because Bank of America uses the same short sale approval letter for all their short sales. In most cases, we have been able to get BOA to state in their approval letter they would "waive" any recourse for the outstanding debt!

In this situation with Dean's clients, a clause in the letter states that BOA and or its investors may pursue the seller for a deficiency judgment. It is a standard, boiler plate letter put together by their attorneys. Most short sale negotiators refuse to remove that language. BOA’s legal department puts it there because it protects them against lawsuits.

There are a couple of issues to briefly address on this case. The deficiency and the legitimate Hardship situation due to the job transfer.

But, if you are a seller then you want to know for sure that you won’t be chase down for a deficiency. If BOA won’t remove that language, then you can’t know for sure whether or not you will be pursued for a deficiency.

Here was our answer to his question. We have convinced BOA on many occasions to remove the deficiency language on a short sale. It's just a matter of requesting it and the owner of the loan being willing to remove it.

We approach the negotiator that they SHOULD NOT pursue the borrowers due to the legitimate hardship of the Job Transfer! This is REALLY a strong negotiating point for the seller; and in most cases, they should never have to impact their credit, by missing payments in order to work the short sale with the lender! Use this to the advantage of the seller!!

(Bank of America doesn’t always own the loan themselves) Ask for an approval letter that states they are waiving all future collection rights.

Stop Foreclosure: Loan Modifications Do Have Some Success!


Denver, CO - If you've ever tried to get a loan modification, then you know how tough it can be. Here is one reason why. The negotiations are all based off of how much the lender can squeeze out of you. The lenders feel like they are entitled to every penny they can get. They won't stop squeezing you until they get repaid every dime.

Let me tell you about a "successful" loan modification that recently happened to one of my affiliate business owners. Remember, right now we are experiencing about only 3% getting approved!!

Many loan modification customers end up paying more than their home is worth. My acquaintance is no exception to this situation! He had a 1st loan of about $250,000, and a 2nd loan of about $70,000. When he first inquired about the loan modification program, since his property was now worth about $240,000, and he was going to have a difficult time making payments in the near future.

Sounds a lot like most homeowners out there, right? Of course, the first error made by the 1st lender was to tell him he had to be behind by 3 payments to work a loan modification! THIS IS NOT TRUE!! Needless to say, he allowed this to happen and impacted his credit!!

Now, just as a side note, LOAN MODS will impact your credit, anyway!! Why?? The bank is NOT receiving from you the original amount of the payments. So, they define you in default each time it is LESS than the original, and WILL REPORT that to the credit bureaus!! This will happen during the "trial period" the banks have you do in order to determine that you are a good candidate for the loan mod. Some times this trial period is for 3 months, and extended once or twice. His was extended 3 times.

By the time it was all said and done, and the lender on the 1st approved a loan mod, they did adjust his interest rate down to 2.5%!! The only added about $11,000 on the bank end of the loan amount to make up for the missed payments and shortage on the trial loan mod payments. This reduction due to the loan mod is saving him about 40% from the original loan payment! This loan modification effort was over a one year period!

The 2nd loan was kept current and was never an issue, so he still has that debt to pay on.

Yes, this is a successful loan modification performed to avoid a possible foreclosure!!

Stop Foreclosure: Reminder, Tax Consequences For A Short Sale?


Denver, CO - This posting is a Reminder about the HB3648, that is still in place through 2012.

Depending on who you are, when someone mentions IRS, it instills fear in most taxpayers. Here is our opinion on the whole forgiveness thing. Please note that all of the info stated below is my personal opinion on this subject. This is not legal or accounting advice. You should talk to a competent legal or accounting professional before making any decision.

You will have Forgiveness of Debt Tax Liability whether you give the house back to the bank or do a short sale. It's true! Before I first started doing short sales, I thought that if the bank foreclosed on your house, you wouldn't get a tax hit. However, I did think that you would get a tax hit with a short sale. So why do a short sale if you then have to pay taxes on the bank's loss? Little did I know that you get hit with the tax liability whether the bank forecloses or you do a short sale.

The government sees it as money you received and never paid taxes on. If you lose a home thru foreclosure, it goes back to the bank and the bank then resells it. However, the amount of supposed debt being supposedly "forgiven" will be much bigger. Why? Because the bank will lose a lot more money. Take the case of a homeowner that CitiMortgage turned down for a short sale. The agent presented them an offer of $385,000, but they rejected it. The bank thought they could get more money after foreclosing on the house and then re-selling it.

However after foreclosing on the house, the bank was only able to re-sell it for $230,000. This left the homeowner's with over $210,000 in debt being forgiven. If the bank had taken their original short sale offer, they would have only had $35,000 in debt forgiven. That's a big difference, right?

Now, here's the good news. The Mortgage Forgiveness Debt Relief Act of 2007, changed all that. Normally, when a lender decides to forgive all or a portion of a borrower's debt and accept less, the forgiven amount is considered as income for the borrower and is liable to be taxed.

However, after the signing of the Mortgage Forgiveness Debt Relief Act, amendments have been made to remove such tax liability and allow the borrower and lender to work freely together to find a common solution that is beneficial to both parties. This protection is limited to primary residences -- rental properties are ineligible for relief -- so consult with a tax advisor. The amount of forgiven mortgage debt allowed to be excluded from income tax is limited to $2 million per year.

Property that was originally acquired as "Income Producing", will not qualify for this tax relief!! So, those that bought an investment property with funds from the lender as an investment property need to get legal counsel to determine their options!

Here is one good thing that comes out of this whole tax thing. It give you lots of ammo to hold off the bank from collecting a deficiency judgment from you. If your bank files a 1099 for the lost income after you do a short sale, then they cannot collect money from you after that. And you can easily get rid of that tax liability by filing a Form 982 with your tax return.
