Stop Foreclosure: One Step to Make Denver Short Sales Happen Sooner!

Denver, CO – Here is a problem: Buyers don't like short sales because of the uncertainty and the wait.

When I first started doing short sales (we called them short pay-offs back then) about 12 years ago, the banks were a lot more receptive to working a short pay-off with the broker's ability to bring in many offers to get the approval done. There was no re-assigning a negotiator or closing out the file causing delays in the process!

We did not have the waiting period that we are face with today, and the lenders would get an appraisal or BPO done in a timely manner. But, let's remember, there were NOT as many short sales back then as we have been dealing with over the last 6 years.

Today, during the short sale process, if the BPO gets completed and the bank won't accept the buyer's offer, they loss mitigation department would close the file, threaten to let it go to foreclosure, or re-assign a new negotiator if you were to bring in a higher offer.

We do our best to request their negotiators / management to keep the file open, due to working counters and back up offers that can expedite the process and keep buyers from walking on us.

There are several reasons that banks should be willing to keep the file open.

Reason #1: Their investor has already spent $65 to $100 on a BPO or $350 on an appraisal.

Reason #2: A bank or servicer's job is reducing the losses as much as possible. Keeping the file open will make the property more marketable, which will allow for the brokers to procure higher offers.

Reason #3: It will help the bank/servicer reduce their costs. It will take less time for them to approve future files, versus if the file had to be completely re-opened, a new BPO ordered, a new negotiator assigned, and the financials reviewed all over again.

Keep in mind, that the servicer of the loan, gets a monthly fee for that service. So, for them to prolong the process means more money for them. The investors need to provide more incentives to negotiate the short sale versus a foreclosure.

In fact, congress is even thinking about making this a law on Fannie Mae & Freddie Mac short sales. Until then, we will have to petition for it on each individual file.

Stop Foreclosure: Notify Congress of Your Failed Short Sales!

Denver, CO – How many "horror stories" do you have in regards to the incompetence of the lender's short sale negotiators / loss mitigation department?

After, losing a short sale transaction to a Large well known Bank, Ok, Wells Fargo ... we decided to gather the data from negotiating with WF, and provide the case to our local Congress persons, via the fax. Do we know if anything comes of it, not at this point, but we want them to KNOW what the taxpayers are feeling, today!!

This short sale listing was worked for 5 months, with NO success by the WF negotiators. They claim it was due to FNMA not working the postponement of the foreclosure sale date. We know it was the incompetence of the negotiator and her management!

We had 3 offers during this time frame, with a CASH offer for over 9 weeks. The cash offer was for $160,000, and we had it listed for 3 months at $158,000 before that offer came in. We had been negotiating for 8 weeks on this offer and the negotiator kept losing the file!!?? She was always missing documents or forgot to work it.

After, many discussions with her supervisor, they finally assigned a new person WHO did not work the postponement with FNMA on the foreclosure sale date!!


Bottom line is, it became a bank owned property 5 months later, and SOLD for $142,000!! YES, they lost approximately $18,000 on this one.

Examples are Fannie Mae owned loans, Freddie Mac owned loans, FHA insured loans, VA insured Loans, and even USDA insured loans.

Get the word out to Congress on these issues, and DO NOT be afraid to name the individuals at the bank, in your correspondence!

Stop Foreclosure: Example of Escalating A Denver Short Sale File

Denver CO – Is it important to "escalate" a file with the lender to get the appropriate attention to accomplish a short sale approval? Here is an example of a recent file with one of the larger banks.

Our listing had been on the market for over 7 months. This property had been in a Chapter 7 Bankruptcy over 3 years ago. Once, it had become behind in payments, in default, the lender has the right to request it be removed from the bankruptcy courts and foreclose on it.

Keep in mind, that the lender has NO recourse against the homeowner since it was in a bankruptcy court.

We had received 2 previous offers on the property that were below $260,000. It was listed at $275,000, and the lender had a BPO of $300,000. SO, needless to say, they would not take the previous offers with many discussions.

In the meantime, we had a new offer come in at $256,000, since all the other buyers had walked on the process.

In order to get this file thru, we had two things to do.

1. Escalate the file.

2. The lender's management reluctantly ordered a NEW BPO! WHY??

To handle Part 2, we sent our own version of a BPO to the lender. We explain to them why we did not think the BPO was accurate and reflected the true market value of this area!

Then, we asked for their supervisor's contact info. After, providing the appropriate data to support the need for a new BPO, they ordered it and it came back at $248,000!!

So, needless to say, the lender accepted the offer that came in at $256,000, within a WEEK! We closed on it in less than 30 days.

Stop Foreclosure: When A Bank Should Approve A Denver Short Sale!

Denver, CO – The Stop Foreclosure Institute believes that the Banks should do their best to approve as many short sales in order to avoid the foreclosure! There should be rules to keep in mind when they review the short sale data.

A bank should accept your short sale when the following rules apply. "All banks and servicers have a fiduciary duty to the investor of the loan". This is an important message to convey to the lender's negotiator and their management!

If they own the loan themselves, they have a fiduciary duty to their stockholders. The duty is to get that investor the most money possible. So, a lender should accept an offer if it will net the most money, when helping them to avoid a possible foreclosure!!

The task at hand is to convince the negotiator that the short sale offer they have in hand will net more than the foreclosure. The best way is to provide the showing history from the listing broker, good SOLD comps, and a report showing the condition of the property, with the cost for repairs! Include the SOLDS of bank owned property, as well, for comparison on what they will lose if it forecloses.

Even with the home being in good condition, chances are there will be needed repairs or updates to justify a higher value to the buying market. This type of data should be presented to the broker doing the lender's BPO request or the appraiser. Help them out with value, too!

When you provide the showing history it will tell them the amount of buyers through the property and provide the feedback from those buyers to the negotiator, as well. Do your best to provide easy to read information and concise data so that the negotiator can work his package to the investor or management for a decision.

It is the task of the seller, Listing Broker and short sale team to provide the best clean easy to understand short sale package to assist the lender's negotiator in obtaining a quick approval based on that offer!

Make them understand why they need to accept and approve this short sale. "Do you honestly think the home is going to sell for more money then?", would be the question they need to answer!!

Stop Foreclosure: Why Be Responsible When You Can Get A Bailout?

Westminster CO – Why does a British Bank do a better job than the American Banks?

We have always liked short sales with HSBC. They respond promptly and are easy to work with. The bottom line is that they do a solid, competent job handling short sales and loan modification.

I think the reason is because they never got a bailout from Uncle Sam. If they are incompetent, then themselves and their stockholders take the loss.

Meanwhile, the large American Banks are awful to work with. I have countless stories of real estate agents working on a large national bank’s short sales for 6-9 months with no answer.

Want an answer to an e-mail? Be prepared to wait 1-2 weeks for that. The people are all overworked. In my opinion, the reason these companies don't care is because they don't own the loans.

For example, Bank of America only owns 20% of the loans they handle. And a lot of that 20% are probably guaranteed by the government because of their purchase of Countrywide.

Contrast this with HSBC. They own most of their loans. That means they are the ones losing money. I couldn't find HSBC ever getting a bailout on the bailout search page. They have a well run bank.

All of their loan mods, short sales, and foreclosures are handled properly. Here is why. They are acting as a principal. If they do a lousy job, then they lose the money themselves.

On 80% of Bank of America's loans, someone else is losing the money. That is why there is no sense of urgency at Bank of America. It's like monopoly money.

Do you think a teenage kid is going to "hot rod around" in his Dad's fancy sports car? Come on! We all know his Dad will treat his car a lot better than his kid will.

So, we can agree that people do a better job if their own money is on the line. The big banks are handling other people's money. There is no accountability.

The investors just hear that the market is bad. They don't know that that is only half the story. At HSBC, if the short sale department does a lousy job, then it affects HSBC's quarterly statement.

If things go bad, then people are held accountable. In my opinion, there is nothing of the sort happening at American Banks such as Bank of America or JP Morgan Chase.

It's kind of sad that a foreign company does a better job than an American Company.

Stop Foreclosure: Walking Away With No Deficiency!

Denver, CO – The Stop Foreclosure Institute has received many questions relating to the issue of short sale deficiencies, over the last year or so.

The one question that remains to be constant, deals with why the lenders will not allow the borrowers to walk away without a deficiency judgment. This is a very common question and familiar situation with a short sale.

"We are in the middle of a very long negotiation with a large national lender. I had my agent put a clause into the contract stating “upon approval of short sale by sellers’ lender, lenders, or affiliates, client, or heirs will be released from any monetary shortages or deficiencies from said sale of stated property upon successful closing and transfer of title from that date and forevermore.”

Too often the lender's short sale negotiators have responded in this manner to the agent, "We will reject the file and close it out if we don’t remove this from the contract." What do you think?

Here is our opinion to this question. I think the negotiator is getting his ego involved. Many loan owners waive promissory notes. He is out of line (and breaching his lender’s fiduciary duty to the loan owner) if the following applies:

1. If it is the investor's policy to not pursue a deficiency.

2. If accepting this short sale will net the investor more money than a foreclosure.

Do these two things apply? You and I don't have millions of dollars to pursue a lawsuit, but we can contact the loan owner directly to let them know what is happening.

If they are going to lose money not accepting the short, then they need to know about what this lender is doing.

Now, the negotiator has the authority to demand a promissory note depending upon who the owner of the loan is. Find out who owns the loan.

Fannie Mae, Freddie Mac, FHA, and VA will let the borrower go free from all future liability. Obviously that doesn't apply if there is Mortgage Insurance.

Find out if any of those entities owns or insures the loan. Then tell the negotiator that you will be contacting them directly

Stop Foreclosure: Getting the Lender to Allow a Short Sale!

Denver, CO – The Stop Foreclosure Institute over the past year has been receiving questions regarding certain lenders that have not been allowing short sales in some situations.

One recent question came in from Joseph, and he said, “I lost my job and am burning up my savings very fast. At the current rate I will only be able to pay my mortgage for a few months more. My lender won’t talk to me about a short sale because I am current on the payments. I am trying to maintain my credit and don’t understand why they won’t consider a short sale until I am delinquent on payments. What is going on?”

Here is a simple answer to his question. Some banks just won’t consider a short sale until you a behind on payments. It’s just the way their policy is provided for their staff. This is NOT always the case with all banks.

Let's go beyond what the lender is willing to allow or not allow, and discuss what makes good financial sense for you and your family!

In my opinion, if you are not employed then saving money is more important than salvaging your credit. Perfect credit won’t do much good when you can’t afford to keep food on the table or pay the light bill.

So Joseph, you need to make a decision based on what is most important to you. I can’t make that decision for you. I will tell you that I would save my cash until I got a job. That process may take you way beyond your financial savings, and then you have thrown money at trying to keep the credit good and still lose the house!

The foreclosure process will drag out for 6-12 months in most states. You can live rent free until you short sale.
