Stop Foreclosure: Learn The Foreclosure Process in Your State!

Denver,CO – How often do you work with a listing broker of a short sale that does NOT quite understand the timeline in their foreclosure process?

This happens way too much! Thus, causing some uncertainty in getting the short sale approval from the bank when less than 30 days from the foreclosure sale date.

In Colorado, we do have an accelerated foreclosure process than a lot of states in the Union. We have worked with other listing brokers that DID NOT pay attention to the timeline OR did not use it for their advantage when negotiating the short sale with the lender(s).

Keep these factors in mind:

1) Some lenders / investors will NOT postpone the foreclosure sale date!

2) There are certain circumstances when less than 90 days from the foreclosure sale date, the HAFA program will be denied, so do NOT waste your time trying to work it!

3) Placing the property on the market with less than 30 days from the foreclosure sale date may be a loss effort! Search to find out what lenders / investors will postpone with a buyer contract in hand and those that will not postpone, regardless of a buyer contract in place.

4) Learn how the short sale lender postpones the foreclosure sale date, and for how long and how many times. (Most will do it for 30 days and at least 2 times). Knowing this may allow you to get a proper buyer contract in place to negotiate the short sale.

Understanding the timeline for a foreclosure sale will help you in becoming a better real estate Advocate for you clients!

Stop Foreclosure: How Does Bankruptcy Play into Short Sales?


Denver, CO – This is a topic that many home owners are dealing with, today. Trying to understand the dilemma of filing a bankruptcy with a home loan in default.

"Should I short sale and then declare bankruptcy. Or just declare bankruptcy and get rid of the house in the bankruptcy? ", they ask themselves.

This is where a good BK or real estate Attorney, should counsel the home owner on the risks of deficiencies, outstanding debt, and tax liabilities.

Learn about the 2 types of Bankruptcy that you may choose to work. Chapter 7 and 13. Each have their own issues and consequences. BK 7 is to eliminate ALL unsecured debts. BK 13 is a reorganization of debt repayment. Both will allow you to keep you home, unless your home loan becomes in default.

Many attorneys have advised some of our past clients, and each one has advised them in different directions. It all depends on the home owners' financial status. Even though a BK 7 can eliminate any debt recourse, we have had some clients that taking that route was STILL NOT the best for them.

By actually doing a short sale on the property, it ended up being the best situation knowing that we were able to negotiate with the lenders to NOT take recourse on the outstanding debt / deficiency.

The debt was gone and he had no need to declare bankruptcy. Not a bad deal, no? Here is the good news for you. First, many states have laws that forbid banks from pursuing you for a deficiency after a short sale or foreclosure. Colorado is NOT one of those states!

Stop Foreclosure: Does a Bankruptcy Assist in Strategic Defaulting?

Denver, Co. - Over the last few weeks, I have come in contact with home owners that have recently filed bankruptcy and included their homes in the BK courts.

That part is NOT unusual, but what comes to the front of our conversation is the question of, "Does it make sense for me to let my house go into foreclosure to eliminate the high debt on my credit?"

Wow, is something in the air? After further discussion, we discover that the home loans were current during the BK 7, and NOW they want to let it go into foreclosure and live in it free for 8-10 months.

They know that the banks / lenders / investors cannot take recourse on them for the debt and any deficiency if it becomes a bank owned. In Colorado, it is a recourse state. Hmmm... makes me think that they were advised to do some kind of "strategic defaulting".

Their BK Attorneys had advised them that they can live their free until the house forecloses. Interesting strategy!

Of course, my question to them is, "Why let it foreclose on you, when you could perform a short sale, and not IMPACT your credit, as much?" Their response was very similar to each other. "We never thought about that, but now I do not have to work with home buyers." Yikes, I do not like hearing that!

I know that our investors, like FannieMae and FreddieMac, take a strong stance on those that have foreclosure on their credit, as well as some lenders. Even taking the same stance on someone that performed a short sale (short pay-off) on their credit.

YET, I do know that those who review credit for OTHER things outside of home loans, i.e.: job applicants, credit cards, car loans, etc... will impact the borrowers' ability to obtain those things with foreclosure on the credit. They have NOT impacted the short pay-off in the same manner!

Stop Foreclosure: What are My Options to Move Forward?


Denver, CO – We recently received a question from a potential client, David, on a very common issue that many have been faced with over the 5-6 years.

Here is David's question. “I have recently been forced into early retirement, and we purchased our home in 2008 for $312,000 from a new home builder. We put down the minimum required of about $11,000, and our current loan balance is about $292,000.

There is only one loan with Wells Fargo. The new builder has closed out the subdivision and after "high" builder incentives, the same model as mine, has sold for around $276,000.

I have to move since the retirement, and I don’t have a job lined up. What are my options?," David.

Here was our answer to David’s Question. I believe that the "short sale" may be your best option. Let me explain why.

First, in most cases the bank will forgive you of the upside down debt. Second, it is a clean break that allows you to move on without having to worry about the house anymore.

Many people would consider renting out their house. But, that will only turn your home into a long term burden. You will have to collect rent each month from the tenant and cover the mortgage if they don’t pay.

The debt still exists and does NOT go away!

Besides, managing a rental home from another town is difficult. You won’t know how the tenants are maintaining it. It will be hard to rent the home to someone else after the move.

You will have to come back to town or hire someone else to rent it for you. This just means more expense and hassle for you. Again, which is why I recommend a short sale.

A third option is to simply stop paying on the home and let the bank foreclose. But, you end up with more credit damage versus if you short sold the home.

Stop Foreclosure: Work the BPO Agent for a Short Sale Success!


Denver, CO – The real estate Broker you hire to short sale your house should know how to “influence the BPO.”

The Broker's Price Opinion (BPO) is a market value opinion of the home, performed by another real estate agent hired by a third party company (asset management company) for the bank / lender.

This function is important to the lenders in their attempt to obtain a fair market value of the home requesting the short sale approval. The lenders want to make sure that when they negotiate with the home owner in agreeing to a short pay-off, that they are getting a "fair" value for the home.

Many of the real estate agents doing BPOs have a heavy work load and will do many of them a day. We as the short sale broker want to make sure they are using the BEST information out there for our clients.

It is important that the information reflects the accurate market conditions and it is presented properly to the lender through the BPO!

Your short sale broker should provide the best market evaluation information to the BPO agent, and to include a property condition report and the feedback from other brokers that have performed showings on the short sale property.

An hour spent influencing a BPO will save countless hours later escalating a file or negotiating more offers. This influence is NOT to "twist the arm" of the BPO agent, but to assist them in preparing the BPO with good hard facts of the market and your property conditions.

If the BPO says the home is worth close to the short sale price, then the short sale will make more sense to ALL parties, and then result in a quicker short sale approval.

Stop Foreclosure: Occupy Wall Street Misses the Target on Banks!

Denver, CO – Occupy Wall Street Protestors are not having the best success attacking Wall Street and the banks. But, that is because they are complaining about what they think is wrong with the situation.

If the protestors only knew the level of incompetence in the banks, then they would have a better argument. Here are some of the glaring mistakes we see the bankers make.

1. Doing an incompetent job on short sales and losing tens of thousands of dollars as a result. We have seen many banks turn down short sale offers only to foreclose on the home and sell it for $30,000 less.

2. Kicking people out of their homes only to lose more money as a result. Many people's homes have dropped in value.

At the same time their income has dropped. But, they can afford to repay the bank, only a lower amount. But, do the banks make the loan modification process easy?

No. Instead, they kick people that could repay them $200,000 out of their homes and then sell the home for $165,000. Again, tens of thousands of dollars are lost.

Yes, I can appreciate that the Occupy Protestors are angry at how hard it is to get a job. But, what about the Americans that are kicked out of their homes?

What about the taxpayers losing thousands bailing out Fannie Mae, Freddie Mac, and FHA? A large part of that bailout cost is attributable to the lousy job banks are doing on short sales and loan modifications.

I think homeowners and taxpayers getting the raw end of the deal are the silent majority. But, we don't have time to protest. so, the banks get away with incompetence. Enough of my rant.

Stop Foreclosure: Do the Problems In Greece Affect Us?

Denver, CO – The Greeks are finding themselves in hot water. They have maxed out their credit.

The government borrowed money and is having a hard time paying it back today. Here is what most people don't understand about how a national economy works.

When the government reduces interest rates to boost the economy and spending, they are actually only acting as a co-signer on the loan. Here is a real life comparison.

Let's say a wealthy person has lots of kids. I'll call him Mr. Wealthy. To boost his kid’s economic activity he lends them money at 1% interest.

However, because he has so many kids, pretty soon he has lent all of his own money. So he starts borrowing money from someone else at 6%.

Pretty soon he has maxed out his credit. In addition, he is also paying the difference in interest payments between 1% and 6% each month. That difference is almost ready to eat up his remaining savings. After he runs out of money; he'll be broke. Let me ask you a question?

How much longer will his kids be able to enjoy below market 1% interest rates? It doesn't sound like much longer to me.

This is what happens when a government with a good credit rating borrows money and re-lends it to citizens for below market interest rates.

It sounds to me like Greece borrowed a lot of money from foreigners and is now having a hard time repaying the debt. A bailout from Germany, the EU, and the IMF hasn't stopped their problems yet.

And it doesn't look like it will be anything other than a short term band-aid. Many say that when Greece does default it will send shock waves thru the global economy.

Who really knows? Either way, it is still a good idea to get rid of upside down debt with a short sale.

Stop Foreclosure: A Lie or Incompetent Lender on My Denver Short Sale?

Denver, CO – The Stop Foreclosure Institute recently received this question from another agent. Here was her question.

“I was just told by the lender on a short sale that they will have to “close” the file because they buyer’s name changed. They said that due to Freddie & Fannie rules if the buyer’s name changes they require the file to closed and reopened.

That would cause the file to drag out another 60-90 days. It would make sense to simply process the file now rather than wait until later. Why lose all the works that has been done up until now just to do it all again 60 days from now?”

Here was our answer to their question. That sounds like a lie to me. Threaten to call Fannie Mae. The phone number is 202-243-5400.

Call them if it takes too long to re-open the new file. Oftentimes, they will re-open the new one in a week.

Stop Foreclosure: When A Bank Should Approve A Denver Short Sale!

Denver, CO – The Stop Foreclosure Institute believes that the Banks should do their best to approve as many short sales in order to avoid the foreclosure! There should be rules to keep in mind when they review the short sale data.

A bank should accept your short sale when the following rules apply. "All banks and servicers have a fiduciary duty to the investor of the loan". This is an important message to convey to the lender's negotiator and their management!

If they own the loan themselves, they have a fiduciary duty to their stockholders. The duty is to get that investor the most money possible. So, a lender should accept an offer if it will net the most money, when helping them to avoid a possible foreclosure!!

The task at hand is to convince the negotiator that the short sale offer they have in hand will net more than the foreclosure. The best way is to provide the showing history from the listing broker, good SOLD comps, and a report showing the condition of the property, with the cost for repairs! Include the SOLDS of bank owned property, as well, for comparison on what they will lose if it forecloses.

Even with the home being in good condition, chances are there will be needed repairs or updates to justify a higher value to the buying market. This type of data should be presented to the broker doing the lender's BPO request or the appraiser. Help them out with value, too!

When you provide the showing history it will tell them the amount of buyers through the property and provide the feedback from those buyers to the negotiator, as well. Do your best to provide easy to read information and concise data so that the negotiator can work his package to the investor or management for a decision.

It is the task of the seller, Listing Broker and short sale team to provide the best clean easy to understand short sale package to assist the lender's negotiator in obtaining a quick approval based on that offer!

Make them understand why they need to accept and approve this short sale. "Do you honestly think the home is going to sell for more money then?", would be the question they need to answer!!
