Stop Foreclosure: Do Short Sales Always Sale Far Below Fair Market Value?


Denver, CO – This is a question that gets asked many times over when confronted with new clients seeking some type of foreclosure relief, in regards to their homes.

This is not always the case! Banks / lenders do prefer to negotiate a short sale of your home rather than the alternative of a foreclosure. But they still seek to obtain a "fair market value" during this process in order to mitigate their losses, too!

In most cases, the owner of a property in a pre-foreclosure (short sale) situation, will most likely still be residing in the home, thus taking care of the property with what resources they have. On the flip side, the foreclosed homes have been vacated for quite some time and they ARE NOT taken care of. Creating a LESS value scenario!

An owner occupied home looks like a home. The furniture and appliances are setup in their proper places. The house is clean and kept up on. Which we still encourage the seller to maintain for higher value offers.

So short sales do not always represent a bargain. They do represent a bargain compared to other homes on the market whose owners may not understand their home's true value. We see an average of 3-10% less than the fair market value.

The bank will not approve a short sale unless the home is selling at or near it's fair market value. So you get a fair price, but not necessarily a bargain when you buy a short sale. As compared to the foreclosed properties that can produce less value by 8-18% on the average!

Stop Foreclosure: Banks Need to be Called Out!!

Denver, CO – In our last post, we ranted about how the bankers do a lousy, incompetent job on short sale and loan modification negotiations.

Here is how you can avoid suffering under their incompetence. The key is to hold your bank accountable. Here's how to do that.

Tell them they can do as good of a job or as bad of a job as they want to on your short sale or loan modification. But, if they do not approve it, and lose money as a result, then you will report them.

Here is an example from an email we sent to a short sale negotiator. (Some of the details have been changed to protect the home seller's identity.)

1. We have had the property at 193 NE Brock Lane for sale for over 4 months. Any buyer who would be interested in that house knows about it. They have decided not to make an offer.

The current offer is for $230,000. That is the highest and best offer we have received on this house. 2. I do not foresee a better offer coming in.

3. I project that if you reject this short sale and foreclose, then the home will sell for around $200,000. Here is how I came up with that number.

A. The local real estate market is declining by about 5% annually.

B. The foreclosure case is going very slow and will probably run for another 9-12 months.

C. Foreclosures sell for about 10% less than other listings.

4. The loan is owned by Fannie Mae. That means they and every American Taxpayer are the ones that stand to lose $30,000 or more. I will be contacting Fannie Mae, all of the members of congress, and my local newspaper.

I will let them know that you, John Doe, rejected this short sale and caused Uncle Sam to lose (another) $30,000.

Do you see how this holds them accountable? This strategy works for loans mods, too. Just run the numbers and see what the projected losses are going to be.

Stop Foreclosure: Do the Problems In Greece Affect Us?

Denver, CO – The Greeks are finding themselves in hot water. They have maxed out their credit.

The government borrowed money and is having a hard time paying it back today. Here is what most people don't understand about how a national economy works.

When the government reduces interest rates to boost the economy and spending, they are actually only acting as a co-signer on the loan. Here is a real life comparison.

Let's say a wealthy person has lots of kids. I'll call him Mr. Wealthy. To boost his kid’s economic activity he lends them money at 1% interest.

However, because he has so many kids, pretty soon he has lent all of his own money. So he starts borrowing money from someone else at 6%.

Pretty soon he has maxed out his credit. In addition, he is also paying the difference in interest payments between 1% and 6% each month. That difference is almost ready to eat up his remaining savings. After he runs out of money; he'll be broke. Let me ask you a question?

How much longer will his kids be able to enjoy below market 1% interest rates? It doesn't sound like much longer to me.

This is what happens when a government with a good credit rating borrows money and re-lends it to citizens for below market interest rates.

It sounds to me like Greece borrowed a lot of money from foreigners and is now having a hard time repaying the debt. A bailout from Germany, the EU, and the IMF hasn't stopped their problems yet.

And it doesn't look like it will be anything other than a short term band-aid. Many say that when Greece does default it will send shock waves thru the global economy.

Who really knows? Either way, it is still a good idea to get rid of upside down debt with a short sale.

Stop Foreclosure: Short Sale Question About Deficiencies!


Westminster CO – The Stop Foreclosure Institute recently received a question from Chris. Here was her question.

"I just got an approval from a large national lender this morning and the approval letter stated the following: “Promissory Note of 0.00.” What does a Promissory Note of 0.00 imply? It is best to know 100% in writing for sure so I don't have that possible issue looming over my head for who knows how long. What are your thoughts on this? Chris."

Here was our response.

If It shows the promissory note of 0.00 is "to assist in the closing of this transaction", my main concern is that Colorado is a "recourse" state. Which means they allow debt collectors to go after any deficiencies with home loans. I would prefer that the lender will agree, in the written short sale approval, not to pursue a deficiency judgment.

Do I think they are willing to modify their approval letter for you? This bank worries more about being legally protected than they do about approving one short sale.

You might be able to get the negotiator to state that they will waive this clause. But, it isn’t always possible. We have seen the pressure put on the lenders by the Mortgage Insurance (MI) companies to mitigate their losses, with these ridiculous "promissory notes".

In other States' cases, the banks can have you sign a contract, but if the law forbids it, then the contract may be legally invalid. Talk to an attorney about whether or not that clause even matters.

Stop Foreclosure: Do Not Be Embarrased to do a Denver Short Sale!


Denver, CO – Many people are embarrassed that they are short selling their house. They feel like they are somehow being dishonest or shady.

Neither one of those is true. A lot of the people short selling today never had a blemish in their credit. They lived perfect, responsible financial lives. Then the real estate market crashed and left them owing way more than their home was worth.

For years everyone had told them that couldn't happen. Many of those people also lost their job for the first time in their life. You must remember, you are not alone. We are seeing as many short sales in the upper income brackets as the lower income brackets.

I will not be judgmental when you short sell with me. I deal with people from all walks of life. Some are high income. Others bought less expensive homes. Either way, it doesn't matter to me. I see a short sale as a smart financial decision.

So I won't be judging you. Instead, I'll be congratulating you. Who wants to be burdened with a huge debt for the rest of your life? Not me. And neither should you. Here is why a short sale is a smart financial decision.

Let us say that you are upside down on a house by $100,000. (If you owe less than that, don't laugh. Many people are upside down by that amount and more.) Repaying $100,000 over 30 years, will cost you $215,000. That is the $100,000 originally owed, along with $115,000 in interest payments.

What if instead of doing that, you put that money towards retirement? You could earn 5% interest on that money. $215,000 at 5% is $10,750 a year. Would that be helpful in retirement? That is one small reason I recommend short sales to my customers. You can get the upside down debt forgiven in a short sale.

Stop Foreclosure: I Have A Moral Dilemma. What Should I Do?


Denver CO – The Stop Foreclosure Institute recently received a question from another agent named Beckie. Here was her question.

I have been waiting on my lender to approve or deny my short sale for 7 months. We finally received an answer last week in form of a counter offer to the price.

The buyer was offering to pay $315,000. The lender countered at $345,000. The buyer is not willing to pay any more than $315,000. My agent told him that he will try my best to negotiate at that price.

Before my agent could send the comps to the lender, the lender ordered an appraisal. My agent tells me that my property is worth more than $315k, but less than $345k.

So, we put the home back on the market just to prove to the lender that at that price there may be no bites. We were mistaken.

We received for $341,550. We told the first buyer if he goes up to what the lender wants, then we will close the deal with him. He didn't budge so we accepted the higher offer.

In the meanwhile, we received an email this morning from the short sale negotiator. She said that the lender will accept the $315k price. Now, my agent is suggesting that we do not submit the $26k higher offer, because that will rock the boat. I have a dilemma.

The first buyer's offer technically was accepted by the lender. I want to give it to him since he waited. But do we have an obligation to the lender to present the higher offer?

We accepted this second offer yesterday without a cancellation from the first buyer. The contract does give us an out. But now that the lender has agreed to the first buyer's price, do we need to sell it to him? HELP ! Beckie”

Here was our answer to Beckie’s Question. Beckie, I personally think that you are not morally required to submit the higher offer to BOA. But, that’s my personal opinion. In the past, we have had some of the large banks actually NOT take the higher value since they had already received approval from the investor on this particular loan.

In that case, it might have stopped the process with a new buyer, regardless of the price of the offer. Then you may lose BOTH buyers waiting for a new short sale approval. Yes, some lenders will assign a new negotiator and that will start the process all over!!

Now, in the case of your short sale offer, it was countered by the bank, at the $345k price. Your listing broker should have taken the OTHER offer since it was closer to the lender's counter! In my opinion, since there was NO short sale approval by the lender / investor, then that OPENED the door for more offers to be submitted for the short sale approval!!

Loan Modification: Is Forbearance an Alternative to a Loan Modification??


Denver, CO - A forbearance is when you catch up all your back payments and continue paying your original mortgage payment. This is a good option for many. However, it doesn't reduce your payment as much as a loan modification does.

Most lenders are glad to negotiate a forbearance. The one advantage is that the process is much shorter. You avoid the lengthy and troublesome loan modification process. A forbearance can normally be approved in two weeks to a month. Contrast this with the one to six month process associated with loan modifications.

The big drawback with a forbearance is that it doesn't reduce your payments. In fact, the first 12 months are tough. Here is why. You are re-paying the back payments during those 12 months. Thus, the lender can use this to COLLECT the missed payments!!

This means your monthly payment actually increases. If you were paying $800 a month before, you are paying $1,150 during the forbearance. Many homeowners accept a forbearance only to default because they can't afford the higher payments.

A good loan modification is what they really need. However, the lender will be reluctant to approve it. Why? Because they already defaulted on the forbearance. This is why I recommend you only ask for a forbearance if you can afford the higher payment OR in some of my clients' cases, they used the forbearance to BUY THEM TIME! Why?

It kept the defaulted loan out of the foreclosure process, and allowed them to use that 6 month or 12 month forbearance to MARKET THE HOME, and negotiate a short sale!!

The Final Numbers On How A Denver Short Sale Reduces Losses

Westminster CO – On our last blog post, we ran some numbers on why a short sale reduces a lender's losses by 20% compared to a foreclosure.

Today I am going to add all the numbers together. That way we can see exactly how much this lender lost by not accepting the short sale.

I am using the real life example of a short sale that was listed for sale for $425,000. The lender turned down an offers for $385,000 and ended up selling the home for $230,000.

Let's add up the costs.

$155,000 in sales price loss. ($385,000 minus $230,000.)

$30,318.75 in lost interest income. ($385,000 lent at 4.5% interest over 21 months.)

$11,411.89 in property taxes that would have been paid by the short sale buyer, but instead were paid by the lender. ($6,521.08 annual property taxes over 21 months.)

$3,000 in estimated foreclosure costs. (This is to pay the foreclosure attorney and the court costs.)

$4,200 in Homeowner's Insurance. ($200 monthly times 21 months.)

$203,930.60 in total lost because they didn't accept the short sale offer. Ouch! I don't care how rich you are (or how many bailouts you received), that is a lot of money.

Yes, these numbers are correct. Real estate is an expensive business. It costs a lot of money to own and maintain a house.

Just look at how much you spend on your mortgage, property taxes, homeowner's insurance, maintaining your house, and mowing your yard. Now multiply that by 21 months. Make sense?

Westminster Short Sales: Is My Hardship Legitimate For A Short Sale?

Westminster CO – The Stop Foreclosure Institute recently received a question from Dan. Here was Dan’s Question.

"I recently purchased another home and tried to sell my former home. It isn’t selling and I can’t afford to make both payments. The home won’t rent for even 1/2 of the mortgage payment.

An agent told me the house is worth about $50K under the mortgage amount. Is it realistic for me to try the short sale? The only hardship created was when I decided to move to a larger home for family. Dan."

Here was our answer to Dan’s Question.

Dan, I think you can short sale your house. Do you have a legitimate hardship?

I know you said you needed a larger house. However, if you also moved for a job transfer, then most lenders would consider that a legitimate hardship.

A hardship is not black and white. Some lenders would consider your situation a hardship. More often than not they will approve the short sale.

Others would not and won’t work with you on a short sale. In addition, the lender may not work with you until you have missed a payment or two.

Whether or not you miss a payment is your decision. You should weigh your options and decide whether or not you can live with the resulting credit damage.

Many lenders will work with you on a short sale even before you have missed a payment. If you were working with us, then we would help you. But, we would have the expectation that it would be a 6-12 month process.

Make sure that you work with a competent short sale agent. Look for someone that is a short sale expert. Ask them how many short sales they have sold.

Ask them if they have worked with your lender in the past. Then you will be able to judge whether they are qualified to help you.

How Long Do I Have To Wait After A Westminster Short Sale To Buy Another Home?

Westminster CO – The Stop Foreclosure Institute gets asked this question quite a bit. The answer depends on the type of loan you are looking to use to purchase your next home.

Here are the details on your options to buy another home after a short sale.

Owner Financing. You can buy a home with owner financing anytime after a short sale.

FHA Financing. (FHA is very popular because it only requires you to put down 3.5% and pay your closing costs. You can usually convince the seller to pay your closing costs, thereby reducing your down payment to 3.5% of the purchase price.)

FHA’s current guidelines state that you can get an FHA loan immediately after a short sale, provided that you never missed a payment. If you were in default at the time of the short sale, then you have to wait 3 years before they will approve your loan.

Fannie Mae Loan. Fannie Mae is the most common loan program. You can get a Fannie Mae Loan in as little as 2 years after a short sale. But, you have to put 20% down.

If you wait 4 years, then you have to put a minimum of 10% down. After 7 years, you can get a Fannie Mae Loan and put less than 10% down.

The most attractive (and currently most popular) loan program in America is FHA. The reason is because it’s down payment requirements are much lower than anyone else. It looks like the best option to buy your next home after a short sale.

Westminster Short Sales: Bank won’t allow my seller to avoid short sale process



Westminster CO – The Stop Foreclosure Institute recently received a question from another agent. Apparently they were being mislead on a short sale by a large national lender.

Here is the question we received: “Do you have a number to contact Fannie Mae? The bank (Large National Bank) will not allow the seller to not do a short sale and agree to repay the loss on a promissory note.

She said that she has to talk to the investor which is Fannie Mae. My sellers just wants to sell and move on with their life.", Janet.

Here was our response. I understand the logic of what your seller is trying to do. They think that they can just sell the home for less than it’s worth, sign a promissory note for the difference, and move on with their lives.

The sad reality is that life’s not that simple, especially when you are dealing with bankers. Before they make any changes on anything, they want to make sure that everything is properly in place.

In order to make sure everything is proper, they will have to process the sale as a short sale. It is in reality a "short pay-off" of what the balance due is. That is why they demand a short sale/short pay-off before they will transfer the upside down debt to a promissory note. This will define the deficiency of the balance due.

They always like to keep things at the status quo. Any big changes need to be very carefully evaluated. It’s just the way bankers work.

So, if your seller wants to sell and repay the debt on a promissory note, then they will have to go thru the formal short sale process. It’s the only option that I see.

Westminster Short Sale: Are The Banks Lying To Uncle Sam



Westminster CO – The Stop Foreclosure Institute recently received an e-mail from another real estate agent. They were asking for our advice on a short sale.

They accused a large, national lender (one of the 4 largest in America) of lying to Fannie Mae. Fannie Mae is almost a subsidiary of the Federal Government.

Here was the e-mail they sent us. ” The lender told the seller that they had to agree to a deficiency or the short sale would not be approved.

The seller said that was unacceptable. They told us they wouldn’t go thru with the short sale unless the deficiency was waived. We notified the short sale negotiator and he sent us a short sale decline letter.
The decline letter says buyer walked. That was a total lie! It appears that this lender told the owner of the loan, Fannie Mae, that the buyer walked when that was not the case.

But, he told us that Fannie Mae was making them do it. I think they are showing this to Fannie Mae to cover their butts!”, Steve.

Our comments on this. This is a big deal. That lender’s legal obligation is to do what is best for Fannie Mae. Short sales usually reduce a lender’s losses by 20%, thereby netting Fannie Mae more money.

For this lender to do this is a blatant violation of their legal obligation. Fannie Mae’s policy is to not pursue short sale deficiencies. They just write off the loss and move on. We have sold many short sales where Fannie Mae waived their deficiency rights.

I think the short sale negotiator’s ego is getting in the way of a deal. They are probably delegated for Fannie. This means Fannie tells them to do whatever they want on behalf of Fannie.

The person not willing to waive the deficiency is this short sale negotiator. This is pathetic and should be investigated.

There is a solution to the problem. I would recommend calling Fannie Mae directly and let them know what is going on.

Westminster Short Sale: Can I Rent My Home If It Is In Foreclosure?


 

Westminster CO – The Stop Foreclosure Institute recently received a question about renting a home in foreclosure.
 
Short Sale Question: I am selling 2 of homes that are short sales. I would like to rent the homes during the foreclosure process. I will continue to pay the home owners association fees. I will not be paying the mortgage.

Here was our answer to them. The Stop Foreclosure Institute is not a law firm. Therefore, we can’t answer as to whether or not it is legal. We recommend that you check with a lawyer before making a decision.

We do know that there are laws forbidding that practice in many states. For example, Florida recently passed a law that stated that you had to notify any potential renter whether or not the home was in foreclosure before renting.

From what we have heard about the law, if you lease a property in foreclosure and don’t tell the tenants, then it is a criminal offense. Check with your local attorneys and tax accountants to understand the legal and tax liabilities.

If it was a problem in Florida, then it was a problem in other states and they probably passed similar laws. We have seen cases in the past where a homeowner sold their home as “Owner Financing.
The home was in foreclosure and buyers filed a police report. The sheriff’s office investigated the homeowner for fraud. The people who thought they were buying the home paid the owner a large down payment.

They didn’t know the home was in foreclosure. He disappeared with their money and they were kicked out by the bank. In some states, the banks must honor the lease agreement, and will receive the rental payments to defray the losses.

Westminster Short Sale: I’m having a hard time negotiating with a HELOC



Westminster CO – The Stop Foreclosure Institute recently received a question about short sales. Here is the question.

“What is your experience with Chase HELOC’s? I have a HELOC that is a 2nd mortgage. Citi (the 1st) will give them 6% or approximately $3000. Chase’s collection agency is saying that they want 30% ($30,000.)

They won’t budge. They want this in CASH, not as a promissory note (in case the seller does a bankruptcy.) They are telling me they will just let the house foreclose because that is Chase’s policy now. What do you recommend that I do?”

Here was our answer to the question. Most third party collection agencies are very tough to negotiate with. They are completely unreasonable.

They are so trained to give ultimatums that they will not budge, no matter how much logic and common sense you bring to them. Here is what you can do.

Go around them. Contact Chase’s CEO. We have been able to contact the CEO of Chase, Jamie Dimon’s Office on other Chase files. Show them that they will receive less in a foreclosure than the $3,000 available now.

Hopefully they will tell the collection agency to approve the $3,000 deal. If that doesn’t work, then ask to speak with a supervisor at the debt collection agency.

Show them how they will actually net zero when the property is foreclosed upon. Tell them that they have to either approve the $3,000 or take zero.

Tell them that rejecting the $3,000 means their client will net zero. Then, tell them that after the property is foreclosed upon, that you will contact their client and let them know how the collection agency’s actions caused them to lose $3,000.
