Stop Foreclosure: Reminder for Mortgage Debt Forgiveness, HB3648!

Denver,CO – We are moving into the last year of the Mortgage Debt Forgiveness Bill, HB3648, that was put into place by the Bush Administration and extended by Obama's until Dec. 20th, 2012.

You are asking WHY is this important?

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

One of the important issues of this HB, is that it allowed for the home loan borrowers to protect themselves from the "TAX Liability" on any deficiencies or outstanding debts incurred due to a short sale process.

Understand that it MAY NOT protect ALL home loan borrowers from the "tax liability", such as an investor that borrowed the funds to PURCHASE an investment property. You might need more assistance from your tax accountant to determine this.

">

Do not forget the implications of HB3648! Reminder for you, if you had performed a short sale closing in the year 2011, get with your attorney and tax accountant to take advantage of this law!

If you need to perform a short sale TODAY, to avoid or stop a foreclosure, get it done before the end of December 2012... or it might be too late!

We all want to avoid the immediate tax implications of a short pay-off deficiency and outstanding debt!

Because most short sales are beneficial to a lender. If you accept our offer to help you on a short sale, your lender may not agree to a short sale or to modify your loan. We do offer a loan modification kit.

However, the likelihood of negotiating a modification is like everything else in life. It takes work and persistence to convince your lender to modify your loan. No matter what you or we do, your lender may not approve a loan modification.

We do not recommend that you stop paying your mortgage, because this will cause damage to your credit and could cause you to lose your home. Because we know avoiding foreclosure is so important to any homeowner, we recommend that you speak with the appropriate legal or tax advisor before making any decision.

Stop Forelcosure: Not All Short Sales Should Have Promissory Notes to Succeed!

Denver, CO – There are numerous stories of how the Seller of a short sale got stuck with a promissory note on the deficiency or a part thereof!

Having the right Short Sale Broker can help determine when it becomes necessary and when it should NOT be allowed, to reach a successful short pay-off approval without deficiency recourse. This does NOT happen all the time, but an experienced Realtor will know the ins and outs of it!

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Here is a good example of this happening. A real estate agent had a short sale with one of the largest lenders in America. The short sale negotiator said that they would not approve the short sale unless the seller came to closing with 50k cash. The sellers said no way.

Fortunately, the agent knew that Fannie Mae owned their loan. The good news for the seller is that Fannie Mae does not ask for promissory notes or pursue deficiencies. (There are a couple exceptions, but they didn't apply here.) If those are Fannie Mae's Guidelines, then why would the short sale negotiator require the seller to bring 50k to closing?

Turns out the negotiator was not following Fannie Mae's Short Sale Guidelines. The agent contacted Fannie Mae directly. Within 72 hours a supervisor called from the short sale department. This time they were singing a different tune.

The sale was approved and the promissory note waived. The seller got to walk away owing zero. Why do things like these happen? Because, in our opinion, there is little oversight over the short sale process. Nothing happens when a short sale gets rejected and sells for less as a bank owned property. No, don't kid yourself, this happens a lot.

These short sale negotiators develop an adversarial mindset. They probably even get paid bonuses based on how much money they squeeze out of short sale sellers. This causes their ego to get in the way of what is best for the owner of the loan. If you are thinking about short selling your home, make sure your agent knows how to research who the owner of your loan is. That info will allow them to negotiate from a position of power. And it will help you avoid a deficiency or promissory note.

Stop Foreclosure: How do I find a Denver Realtor that specializes in short sale

Denver CO – Are you looking for a Denver Realtor that specializes in short sales. It is important that you pick the right agent. Many agents turn down short sale listings because they are unfamiliar with the process. These transactions are much more difficult and complicated than your average real estate transaction.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Because of the foreclosure process, you usually only have one chance at a short sale. If your first agent isn't competent, then you risk losing your house to foreclosure. Then you have to wait another 5-7 years to buy your next house. First, ask the agent you are interviewing why they qualify to help you. Do they have any special short sale training or designations? Many agents have taken specialized training and education. They care about being up to date with the current trends in the market.

Next ask them how much experience they have selling short sales. An agent who has closed a few short sales is a lot better prepared than an agent that has not. You want someone experienced working for you.

Who is your lender? Ask the agent is they have closed any short sales with your lender. Every lender handles short sales a little bit differently. If your lender is ABC Lender and the agent has experience with ABC Lender, then they already know the process. Your agent will be prepared because they are familiar with that lenders' process.

After that, ask the agent how they negotiate their short sales? They may do the follow up themselves. Or, they may hire a competent title company or loss mitigation company to do it for them. Either way is fine. Just make sure the person handling your file is suited for the job.

Stop Foreclosure: Short Sale Question-Can My Lender Force Me To Repay Them?

Westminster CO – A lot of homeowners want to short sale and walk away from the upside down debt. They don’t feel that it is their fault the housing market crashed.

We get the following questions a lot.

“If I short sale, then how likely is it that my lender will sue me to repay them?”

“Will my lender garnish my wages or take money out of my bank account?” So I will answer those questions in today’s post.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

The answer is that it is unlikely that any of that will happen.

Here is the #1 reason this usually doesn’t happen. About 65-70% of all short sale lenders will allow you to walk away owing nothing. The remaining lenders are usually too busy or disorganized to do anything.

Lawsuits cost money and they usually don’t get enough money back to justify the expense.

Here is the #2 reason this usually doesn’t happen. You can’t squeeze money out of someone who doesn’t have any money. The lenders know (from past experience) that if they push a debtor to hard, then that person will just declare bankruptcy.

So the lender gets no money anyways, but they lost money on the lawsuit and collection tactics. (Bankers don’t like to lose money.)

In addition, wage garnishment is difficult. There are many different exceptions and protections against wage garnishment.

For example, if the person being garnished is the main provider for a family, then the laws are often written to stop any garnishment against them.

This is why 80% of all judgments expire uncollected. Even though the legal system gives lenders lots of collection rights most judgments still expire unpaid.

I know these stats may not be very comforting. If you are still concerned, then contact a good bankruptcy or consumer defense attorney. Thinking about a short sale?

Stop Foreclosure: A Reason Lenders Lose Paperwork on Denver Short Sales!

Westminster CO – If you have negotiated a short sale or loan modification, then you have probably heard the lost paperwork excuse. “Oh, we lost your paperwork. Or, we are missing that document. Please refax it to this number”, the lender’s representative tells you.

I have heard this excuse countless times. No one can lose paperwork that much. I am now convinced that it is a lie. But, why would a lender blatantly lie like that?

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

In my opinion, they do that to make up for their failings. See, most loan modification and short sale departments are stretched to the max.

The employees are overworked and underpaid. Everyone just gets into the mindset of not caring. They have to deal with angry people every day.

The people are understandably angry and they want some answers. But, because nothing it getting done, the employees feel bad. But, rather than tell the customer what is really happening, they make something up.

No one wants to tell someone that nothing has happened on the file in several months. It will make that person even angrier. It could even start lawsuits against the lender.

It is much easier to tell them that their paperwork got lost somehow. It they tell them that, they will think it is a legitimate excuse and refax the paperwork.

Problem solved for the lender. But, doesn’t that cause more problems for the borrower? Thinking about a short sale?

Denver Short Sales: A Reverse Mortgage Short Sale Nightmare?

Westminster CO – Here is a story about a Reverse Mortgage Short Sale which is still in the process of accomplishing a satisfactory conclusion! It may foreclose before resolving the issue!

I want to share the oddity of this situation, in the event you ever come across the same situation. Be careful, with the reverse mortgage foreclosures out there!!

Bear in mind, this is based on the laws of Colorado and the foreclosure process taking place in the Denver County.

We have a client that is in the foreclosure process, and one postponement of the sale date has occurred. The lender is James B. Nutter, they work "reverse mortgages" and have recently filed foreclosure on a property in Denver.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

To understand reverse mortgages, one must know that the lender will never call the note due until the death of the individual on the note. This balance due, at this time, is $293,850, with an estimated value of $462,555. (That est. value was based on a future value of the property when the loan was taken out in 2008)

Property value, today, is around $225,000, based on the current market and property condition!

The individual on the note, had passed on a year ago. Here lies the issue! The property is deeded in Title to TWO individuals (Husband and Wife). They acquired the property in 1963 as Joint Tenants. The wife is the only individual on the Deed of Trust and Promissory Note (In Colo. we use Deeds of Trust and Promissory notes, NOT mortgages), and she is the only one identified in the foreclosure recording.

Why is this an issue? Simply stated, the Title company, Chicago Title, did not perform the proper title search when they performed the closing on behalf of James B. Nutter. Not ALL Parties to the Title were included in the reverse mortgage refinance!!

Now, with the foreclosure sale date coming up soon, when James B. Nutter places it's bid, and then becomes the winning bid at the sale, do they own the property outright? OR, have they become "partners" with the Husband who is still on title? Interesting situation, here!!

We believe, attorneys and my office, that they will in fact be Tenants in Common, since the Wife had signed her interest away on the reverse mortgage, and THAT is what James B. Nutter is foreclosing on! The Husband is the other owner, and now he TOO is a Tenant in Common!!

Stay tuned for an update within the next month, and we shall share the continuation of this "reverse mortgage short sale" or "foreclosed" saga!!

Short Sale Your Denver Home and Worried Lender Might Foreclosure On It First?

Westminster CO – Short sales can drag out. It takes 1-2 months to sell the house. If longer, you may need to implement periodic price reductions to encourage offers! Then, the short sale negotiations start.

View My homes for sale at www.youtube.com/watch?v=CFvdzkF68Cg.

They can drag out for 3-6 months. In the meantime, if you aren’t paying on the mortgage, then the lender will be trying to foreclose on the house.

Here is the best solution. Have a good complete short sale package and a legitimate offer into the lender to negotiate the postponing of the foreclosure sale date. In Colorado, we still find this to be the better way of getting the sale date postponed! Since, we have an accelerated foreclosure process that takes place 110-120 days after recording!

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

In another state, here is an extreme example that one real estate agent had his seller do.

"Here is what I had to do. In the case of looming foreclosure sale date then, I get the owner to go to the courthouse and file a petition with the foreclosure judge", Alberto said.

(The owner is the only one allowed to do this. I think the actual legal term is a motion.)

"The seller will be asked to go to a hearing with the judge. The owner goes to the room where the judge is holding session. They sign in and wait to be called.

The owner will be only one allowed to speak and they must explain the situation. The owner explains that there is an offer on the property and that they need some time for the lender to process the short sale."

I always recommend that the seller take copies of everything to show the judge. They bring the sales contract and the buyer’s loan approval.

Most of the time, the judge will grant their request and extend the foreclosure sale date by 90 days. The only exceptions are when it has been postponed several times already.

This may not work in all situations, but was successful for Alberto. Discover what lenders will NOT postpone the sale date, and you may have to use this approach!

Denver Loan Mod Help: Why it is cheaper to short sale and rent versus getting a loan modification

Westminster CO - Many people are shocked that it is often cheaper to short sale and rent that staying in your home with a loan modification.

View my VIDEO BLOG atwww.youtube.com/watch?v=OMsVzufxdwg

They find it hard to believe that they can rent a comparable or even nicer home for less than their mortgage. Here are the two factors that make it possible.

Get my Free, Step By Step Loan Modification Guide by clicking here.

Many homeowners bought homes for more than they are selling for today. A perfect example is a homeowner that paid $430,000 for a home, in 2006. His mortgage payment was around $3,228 (includes property tax and Insurance) a month. This same home is now selling for around $310,000!!

He stopped making his payments and started negotiating with the lender on a loan modification, and after 4 months they started the foreclosure. He finally received a "trial period" loan modification for 3 months, and they would postpone the foreclosure. After that 3 month trail period they would decide whether to provide a final loan modification approval and withdraw the foreclosure.

They wouldn’t drop the loan mod payments below $2,570 a month, during this trial period. The homeowner located a few rentals (similar to his owned home) they can rent for around $1650-$1,800 a month.

Today, someone can buy that house for $310,000 and rent it for $1,800 a month without losing money. Far below what the loan modification payments would be. That is what makes it cheaper to rent versus getting a loan modification and staying in your home.

PLUS, they would tack on $30,000 on the back end of their home loan for the missed payments and loan mod payments shortage of the original note.

When prices were rising it was actually more expensive to own versus rent. But, folks were buying homes for the purpose of appreciation and speculation (wrong reasons), so offers were coming in high to buy!!

House prices have dropped considerably since then. Yes, rents are not at an all time high! Rents did drop during the early economic crisis and have since been making a come back. But, still not equal to the monthly home loan payments prior to the last year!!

So, if you are thinking about a loan modification, then first check into the rental market. You will be able to negotiate your loan modification from a position of power.

That will make it more likely that you will get the reduced payment you need so you can keep your home.

Thinking about a loan modification? Our Westminster loan modification guide will show you how to reduce your mortgage payment, keep your home, and get back on your feet. Send me an e-mail at denverloanmodhelp@gmail.com to request a Free Copy.

Who Benefits From A Denver Short Sale?

Westminster CO – Even though lenders pretend to hate short sales, they actually benefit from short sales. Let me explain why.

View my VIDEO BLOG atwww.youtube.com/watch?v=GUQrS_8_6ss

A lender gets to sell the house at today's price, versus what it will be worth 6-12 months down the road. We just did a comparison and pulled up sold listings.

All of the listings were the same, very comparable, and located in 3 similar, comparable neighborhoods. All were less than 2 miles apart.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

First, we looked up the average selling price per SQ FT of homes that sold in a 3 month period. In spring 2009, all the homes sold for an average of $103 a SQ FT.

Then, we pulled up houses in the same neighborhoods that sold after the bank had foreclosed on them. Those sales were 6-9 months later than the original sales.

6-9 months later, the average sales price of a home in these neighborhoods was $85 a SQ FT. These homes average 1,700 a SQ FT.

That means a 1,700 foreclosure sold for $30,600 less than it would have sold as a short sale six months before. Ouch! Sure, most short sales are cheaper than comparable bank owned or "seller with equity" sales.

But, we're bringing a tremendous amount of value to the bank. The other person that's getting value is the buyer. They get a better deal in today's market than buying a "seller with equity" or REO(Real Estate Owned).

You, the seller is also getting a better deal. You get a lower deficiency and your credit is back to normal in 18-24 months.

A short sale is a win - win for everyone involved. Thinking about a short sale?

I can help you short sale your property and get back on your feet. Send me an e-mail at denverforeclosureblog@gmail.com. I will contact you for a free consultation.

A Common Westminster Short Sale Marketing Mistake: Your Realtor Doesn't Make Sure That Your Home Shows Well

Westminster CO – When another agent brings a buyer to look at your home your realtor should follow up afterwards to obtain any valuable feedback from that agent.

Again, the purpose of feedback is to find out what buyers think of your home. If you want to sell your home, then it needs to show well. Here are a few tips.

1. Open the blinds and curtains. Bring in as much outside light as possible. Most showings happen during the day, whether during the week or on the weekend.

Turn on as many lights as possible. Buyers want to buy an open and bright home. They don't want a "cave."

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Sure, they will turn the home into a "cave" after they buy it. They will have the blinds closed most of the time. They will install curtains and never let any natural light into the house.

But, that doesn't mean they want to buy a "cave." Yes, I know it's crazy. I guess it's just human nature at work.

2. Your home should be clean, tidy, and well groomed. Fix anything that doesn't look right. If your sidewalk is black from algae, then pressure wash it off. Put new mulch in the front flower beds.

3. If you have a good sense for decorating, then decorate! Make your decorating neutral enough that most people will like it, and remove all your personal items, like family pictures! If you have an empty room, then rent some furniture and put it in there. Try to stage it!

Buyers have a hard time imagining if their furniture will fit in a room. They usually think that they need more room than they actually do.

If they can see furniture already there, then it helps bridge that gap. They can see for themselves that their furniture will fit.

4. Get the carpets cleaned. If your carpet is old, but you can't afford to replace it, then hire a good steam cleaner. Ask someone who manages an apartment complex for a referral.

Most apartment complexes know a carpet cleaner that can get the so called "impossible stains" out of carpet.

A Common Westminster Short Sale Marketing Mistake: Not Preparing Buyers to Acquire Short Sales

Westminster CO – When another agent brings a buyer to look at your home your realtor should follow up afterwards.

View My homes for sale at www.youtube.com/watch?v=4nN5ORcNKrI.

They need to get feedback on what the buyer/selling broker thought of your home. If the buyer liked your home, then they will ask if they are thinking of making an offer.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Too often, the feedback we get on our short sale listings comes across as this, "This buyer feels the property has too much work to do", or "They do not have the extra funds to correct the necessary repairs, so they must move on".

This is a common concern. So, it makes you wonder if the buyer's broker is consulting with them about the nature of short sales. Also, the fact of these short sale listings are being strictly sold "As-Is". Meaning, the seller will never provide seller concessions for repairs or price reductions based on a buyer's inspection.

Thus, the buyer will have to correct or replace any deficiencies on the property, with their own sweat and funds. Which brings me to this concern about buyer's agents preparing their buyers to acquire short sales.

All buyers should be counseled about the types of financing that is available to them for such things as short sales and bank owned properties that will require work to be done to satisfy their living requirements.

FHA 203K, Rehab loan, is a great finance tool for short sales. We have worked these type of loans for short sales and they handle the concerns for the work that is required, i.e.: new windows, new roof, new HVAC systems, or required repairs for loan conditions.

If your realtor follows up, then they can handle those concerns and get a buyer off the fence and convince them to buy your home.

I can help you short sale your property and get back on your feet. Send me an e-mail at denverforeclosureblog@gmail.com. I will contact you for a free consultation.

Denver Short Sales: Why Should I Short Sale?

Westminster CO – We often get asked if a short sale is even worth the effort. “Why don’t I just let the bank have the property”, sellers tell us. “I don’t ever think I’ll be able to fix my credit to be able to buy another house.”

Get my Free, Step By Step Loan Modification Guide by clicking here.

When you are having a tough time financially, it may seem like you will never get back on your feet. But, most people do get back on their feet.

They find another job and start making money again. Their credit will usually be back to normal in 2-3 years.

Why not buy a new home at that time? If you short sale, then you will be eligible to do that. Fannie Mae will consider you for a new loan 2 years after a short sale.

You would have to meet all of their credit guidelines and other lending criteria. Most derogatory credit items such as late payments or collections won’t have as much of an impact when they are 2 years old.

In addition, there are many ways to get derogatory items removed from your credit. The other great option is an FHA loan. FHA allows you to buy a home with only 3.5% down.

Current FHA guidelines will loan to you 3 years after a short sale and a foreclosure, but the foreclosure will stay on your credit 7-10 yrs! This credit "derogatory" may impact other things, i.e: job employment, credit ratings, etc. Not to mention the "outstanding debt" and "deficiencies" that still are in place, after a foreclosure!

That is the number one benefit of a short sale. You can get back on your feet and buy another home a lot faster than if the lender forecloses on your home. Thinking about a short sale?

I can help you short sale your property and never pay the bank another penny. Send me an e-mail at denverforeclosureblog@gmail.com. I will contact you for a free consultation.

A Common Denver Short Sale Marketing Mistake: Not Marketing Short Sale Listings to Prospective Buyers

Westminster CO – Here is a quick story that illustrates this point. An agent I know was hired to sell a 30 acre tract of land that was a short sale.

Several months earlier they had spoken with a buyer that was looking for a similar property, but that agent had never talked to the buyer about short sale listings.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

However, the buyer had said they were looking for something closer into town, and never thought about looking at short sales. So while consulting with those buyers, this broker did not cover the benefit of buying a short sale listing. Never assume that a buyer is not interested in acquiring a short sale!!

The buyer had discovered this short sale listing when inquiring about other properties with a different broker, and decided to investigate this property and ended up being the buyer of the 30 acre listing.

In this case, the seller was fortunate that the property sold. But, it illustrates the importance of a realtor marketing their homes to their active buyers.

Those buyers already know and trust that realtor. They are the most likely prospects to buy the homes that agent has for sale. Provide the information and let the buyer make the decision of whether or NOT they would entertain buying a short sale listing.

I can help you short sale your property and get back on your feet. Send me an e-mail at denverforeclosureblog@gmail.com. I will contact you for a free consultation.

This is not intended as legal, technical, or tax advice. Please speak with a licensed professional before making any decision. Information is deemed reliable but not guaranteed as of the date of writing.

You have the option to reject a short sale or loan modification from your lender if it does not meet your approval. If you decide not to go thru with the short sale, then you do not have to pay us our fee. We normally make a real estate sales commission for helping you on a short sale.

A Common Denver Short Sale Marketing Mistake: Not Using the MLS Properly

Westminster CO – This MLS Mistake could cause the right buyer to never look at your home in the first place. The Multiple Listing Service (MLS) is the first place an agent representing a buyer is going to look for homes for sale.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

(The Multiple Listing Service, which I will call MLS for short, is the database of homes for sale that all realtors in a certain area share, and communicate how they will co-op with each other in buyer / seller transactions.

When an broker has a buyer and their own homes for sale won't fit that buyer's needs, then they search the MLS for all properties listed by other brokers.

If another broker has a home that fits that buyer's needs, then they can sell the other broker's listing.)

In today's market agents have a lot of homes to pick from. Ten, twenty, thirty, and sometimes even a hundred homes fit their buyer's criteria. But, they will usually only show that buyer 5-7 homes at one time.

If these agents don't pick your home from their MLS search, then you just missed a potential buyer. Here are a few reasons that certain homes get skipped over in the MLS search.

Reason #1: The main picture of the house is ugly or unattractive. The agents are usually scanning thru lots of listings and don't have time to look at all the pictures.

If the main picture is unattractive, then they will pass on showing the home. We use a youtube video to showcase our listings, are your listing broker's doing that?

Reason #2: The property is put into the MLS wrong. For example, many MLSs have a search function for the size of the lot.

The agent puts in 0 acres for the lot size. The house will not show up when an agent searches for a lot size between .5 acres and 1 acre.

Nor will it show up in any other search that has a specific lot size. This might not be a big deal if you don't have a lot with a bigger than normal yard.

But, I can tell you from specific experience that this will hurt your sale if you have a larger than normal lot. There are many other MLS mistakes, but this is a specific example to show you how it can affect you.

Reason #3: You don't price your home at $25,000 increments. Most buyers use $25,000 increments when searching online. Pricing it right, even as a short sale, will encourage buyer traffic.

For example, they will search for a home priced between $200,000 and $250,000. If your home is priced at $250,000, then it will show up in multiple searches.

A $250,000 home will show up in a search for homes priced $200,000 - $250,000 and a search for homes priced $250,000 - $300,000.

This increases the likelihood of the right buyer seeing your home in the search results and therefore the likelihood of your home selling.
