When confronted with a life changing event that forces you to miss your home loan payments, and you feel there is NO way out, you might want to consider the option of performing a short sale, rather than a "deed in lieu" or just plain walking away and letting the bank foreclose to take the property from you!

Stop Foreclosure: Reminder for Mortgage Debt Forgiveness, HB3648!

Denver,CO – We are moving into the last year of the Mortgage Debt Forgiveness Bill, HB3648, that was put into place by the Bush Administration and extended by Obama's until Dec. 20th, 2012.

You are asking WHY is this important?

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

One of the important issues of this HB, is that it allowed for the home loan borrowers to protect themselves from the "TAX Liability" on any deficiencies or outstanding debts incurred due to a short sale process.

Understand that it MAY NOT protect ALL home loan borrowers from the "tax liability", such as an investor that borrowed the funds to PURCHASE an investment property. You might need more assistance from your tax accountant to determine this.

">

Do not forget the implications of HB3648! Reminder for you, if you had performed a short sale closing in the year 2011, get with your attorney and tax accountant to take advantage of this law!

If you need to perform a short sale TODAY, to avoid or stop a foreclosure, get it done before the end of December 2012... or it might be too late!

We all want to avoid the immediate tax implications of a short pay-off deficiency and outstanding debt!

Thinking about a loan modification? Our Westminster loan modification guide will show you how to reduce your mortgage payment, keep your home, and get back on your feet. Request your FREE copy,BELOW

Because most short sales are beneficial to a lender. If you accept our offer to help you on a short sale, your lender may not agree to a short sale or to modify your loan. We do offer a loan modification kit.

However, the likelihood of negotiating a modification is like everything else in life. It takes work and persistence to convince your lender to modify your loan. No matter what you or we do, your lender may not approve a loan modification.

We do not recommend that you stop paying your mortgage, because this will cause damage to your credit and could cause you to lose your home. Because we know avoiding foreclosure is so important to any homeowner, we recommend that you speak with the appropriate legal or tax advisor before making any decision.

Stop Foreclosure: Don't Be Embarrassed by a Westminster Short Sale!

Denver, CO – Short Sales are a situation that can often cause emotional turmoil as well as financial. It’s amazing how quick people are to judge others but times may be changing when it comes to today’s financial situations. We’re all feeling tough times. We all have seen local businesses close, people we know losing jobs they’ve had for years, and seen how the cost of living increases while the income we’re making doesn’t seem to be keeping the same pace.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Most of us don’t speak “legal-eze” and personally I’m thankful that most of us also don’t operate like some lenders. It’s hard to understand why a lender will jump at doing a Short Sale on a home as opposed to working with someone who’s done everything in their power to make right the situation they’ve ended up in, being overdue with the lender.

Many lenders somehow find it more logical to do a Short Sale than to work with the original owner and re-finance or negotiate terms that make it more reasonable for the owner to make regular payments again. Placing the overdue amounts at the end of your loan and putting you back on track seems more logical to you and I than taking a Short Sale. But then again, when does our logic seem to match the logic of most lenders?

What we have noticed though is that while we are all together in this financial mess of our economy we also seem to be more sympathetic and understanding about the situations of others. Friends and neighbors aren’t so quick to judge those who suddenly have a “Foreclosure” or “Short Sale” sign on their front lawn. People have become more sympathetic to those in their community who have been hit hard by hard times. There is no longer a scarlet letter worn by those who have hit hard times and find themselves having to give up their home via a Short Sale.

There is no shame in Short Sales. In most cases the home owners have approached their lender in every possible way, using every possible means to keep their home. Most lenders turn down every option other than literally snapping your fingers and coming up with all of the money owed instantly, no matter what the situation may be. These lenders should bear all of the shame for creating situations that don’t allow for a good, honest homeowner to maintain their dream.

A Short Sale is an option that is taken to help keep your dignity, sell your home, and have a fresh start. Many take this choice hoping to do less harm to their credit rating. Many times friends and neighbors will not only understand your situation but will respect that you’ve remained dignified through a terrible crisis in your life. Each of us understands that we are almost all only a paycheck away from being on the streets in today’s economy.

As we work together to make things better, one of the things we notice is that there truly is a lot less judging and finger pointing going on in life and a whole lot more understanding and help. The fingers are pointing to the lenders now instead.

We are here to help you understand and get through making the choices you need to make regarding a Short Sale of your home. We have the knowledge and training behind us to make your transition as smooth as possible. Most of all we will treat you with respect and help you not only make the experience understandable, but bearable. We can give you information that will give you hope and show you that the future may have a better picture ahead and even another home some day with our help. There is no shame in taking the option of a Short Sale and we are here to show you.

Stop Foreclosure: First Impression, the Curb Appeal of Your Home!

Denver, CO – No matter what the circumstances are when you’re selling your home, you want to get top dollar for it. Packaging the property to make it more attractive is the "curb appeal" you are seeking!

First impression is what you are seeking when placing a home on the market. In some geographical markets, the exterior will always look appealing during certain times of the year. As an example, in Colorado, the grass, trees, flowers, and other outside decor looks best between the months of May and September. That is the "packaging" that appeals to the prospective buyer!

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

During the other months, in Colorado, you must ensure that other items create an attractive curb appeal to capture that first impression. The day you are showing a property, there may be snow on the ground and the exterior vegetation is not a part of that curb appeal. Neither is the driveway and sidewalk with snow pack on them. (Other words, clean them off)

When you’re sitting there at a holiday get together or at a birthday party, the first package that catches your eye is the package that’s wrapped perfectly. The one gift that looks well cared for and beautiful on the outside. From that one look of the outside wrapping of that gift you just know that whatever is inside has to be something special if the person took that amount of time in wrapping it so perfectly.

The same goes in the opposite direction also. If someone stops at the last minute and literally just leaves the gift in the bag from the store they bought it from and slaps a bow on it, your first thought isn’t “wow that’s got to be a great gift” but instead you probably barely glance in that direction. It could be a great gift but the presentation says that the gift giver didn’t put a whole lot of time, effort and thought into it so chances are whatever they bought didn’t have a whole lot of thought put in it either.

Your home is much like that birthday gift or special holiday gift. The “wrapping” is the outside curb appeal. If someone is driving by and they see this beautifully wrapped home, one with perfect lighting placed in just the right spots, clean driveways and sidewalks, trimmed bushes and freshly painted trim they’re going to take a second look. However, driving by the house that is just sitting in a plain bag with a bow, trim peeling, overgrown, untrimmed bushes and landscape with no appealing lighting on to help them see the entire area is going to cause the potential buyer to literally not even give the house a second look as they drive by.

The inside of the house could be immaculate and have every amenity imaginable but because it wasn’t “wrapped” in beautiful gift wrap with a sparkling bow and attention grabbing beauty, it will either be passed by or if out of desperation they do look further they’re going to offer a lot less simply based on the shabby packaging.

So that’s curb appeal. Curb appeal is the beauty a potential buyer sees from the outside before they ever even begin to approach the inside. Curb appeal is what makes them say, “We should really take a look at this one!” You can see how important it is that the curb appeal of your home be that perfectly wrapped package. Make your house be the package that jumps out amongst the other gifts. Make those potential buyers drive by and say “We have to open that package! Anyone who took the time to make it look so perfect has to have good taste! It can only get better from here!”

That is how important curb appeal is in selling your home. Make your home shine from the outside in and give them the feeling that with a beautiful bow and perfectly matched paper, this is the gift they want to open!

Stop Foreclosure: Does a Bankruptcy Assist in Strategic Defaulting?

Denver, Co. - Over the last few weeks, I have come in contact with home owners that have recently filed bankruptcy and included their homes in the BK courts.

That part is NOT unusual, but what comes to the front of our conversation is the question of, "Does it make sense for me to let my house go into foreclosure to eliminate the high debt on my credit?"

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Wow, is something in the air? After further discussion, we discover that the home loans were current during the BK 7, and NOW they want to let it go into foreclosure and live in it free for 8-10 months.

They know that the banks / lenders / investors cannot take recourse on them for the debt and any deficiency if it becomes a bank owned. In Colorado, it is a recourse state. Hmmm... makes me think that they were advised to do some kind of "strategic defaulting".

Their BK Attorneys had advised them that they can live their free until the house forecloses. Interesting strategy!

Of course, my question to them is, "Why let it foreclose on you, when you could perform a short sale, and not IMPACT your credit, as much?" Their response was very similar to each other. "We never thought about that, but now I do not have to work with home buyers." Yikes, I do not like hearing that!

I know that our investors, like FannieMae and FreddieMac, take a strong stance on those that have foreclosure on their credit, as well as some lenders. Even taking the same stance on someone that performed a short sale (short pay-off) on their credit.

YET, I do know that those who review credit for OTHER things outside of home loans, i.e.: job applicants, credit cards, car loans, etc... will impact the borrowers' ability to obtain those things with foreclosure on the credit. They have NOT impacted the short pay-off in the same manner!

What are your thoughts about this type of "strategic defaulting"?

Stop Foreclosure: How A Denver Short Sale Broker can Help You!

Denver, CO – While most people think of Realtors as a person you turn to only when you’re buying or selling a home; many don’t realize that a Realtor’s expertise in the housing industry can help you in other ways also.

If you are facing possible foreclosure, turning to a Realtor that is a short sale expert will have the tools to assist you with this critical situation

While Realtors can’t give legal advice about handling foreclosures, they can show you many options that are available to you as both a home owner facing possible foreclosure and as a possible home buyer if you should have to release your home to the lender.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

1.) The right Denver Realtor, will know the area well and be able to guide you as to how others in your situation in the same area have handled similar circumstances.

2.) A Realtor can explain “Short Sales” to you; which could be an option for you depending upon your situation.

3.) Your Realtor should be able to explain possible options for re-financing, doing a “short sale”, seeing if a loan modification is an option or perhaps even a mortgage forbearance. There may be other possible options available in your area; including any governmental or non-profit organizations that may be able to help.

4.) Working with one Realtor you can trust will not only establish a friend with useful information, but they will be there after the foreclosure when you’re going to need to know where to turn. They will have options available for you from rental units to get you through this tough spot, to possibly even purchasing a new home. You may be surprised at the options available. Having someone experienced in the business will be a plus no matter which direction you go once you finish the foreclosure process.

5.) Find a Realtor in the Denver area that truly cares. Yes, we are Realtors to make a living; it is our job. But we are also human beings and should remember to work with you while making you feel as good as possible with the options you may have. Perhaps this is a dark moment for you and your family but the truth is, if you have a good Realtor, with "Short Sale" experience, you should have a good chance at finding a decent home, either as a rental or other possible ways of purchasing it. That’s where an experienced short sale broker comes in… we know the “other possible ways” out there.

Stop Foreclosure: Are Banks Improving the Short Sale Process?

Denver, CO – Recently, we have seen some news in regards to the large banks, like Bank of America, indicating that we can start the short sale process prior to receiving an offer from a prospective buyer.

Is this something new or are these banks waking up to how the process in the past had some merit?

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

This will help to reduce the short sale timeline. All of the documents will be submitted and if the negotiator needs anything else, they can request it earlier in the process. This also allows Bank of America to contact the owner of the loan earlier. This is important as some loan owners can take a while to respond.

We think this is a good development that will make Bank of America short sales easier. It also shows that the lenders are working to make the process smoother and easier.

Now, why would I say that the ways of the past had some merit? 8-10 years ago when working short sales was not the fad, but more of "isolated situations" to negotiate a short pay-off.

I can remember how simple it was to get a short pay-off approved within 60-90 days with out the difficulty of today. It was not unusual to submit a HUD-1 with what we, the real estate broker, would believe the property would obtain an offer at and create the net to the lender, right up front with the HUD-1.

We did not have a buyer in hand, but would negotiate the "net value" with the lender, thus determining our market price to satisfy the lender's required net. The end result, in a timely manner, was a qualified buyer and a short sale approval!

Then the lenders / banks / investors got overwhelmed with the high pre-foreclosure and foreclosure market, and could NOT handle the volume of those defaulted loans hitting their loss mitigation depts. They decided to incorporate the new regs and rules (just like the demanding financial package from the borrower), in order to deal with that volume. Instead, it created a LONG approval process.

Oh, how I MISS those days of getting short pay-off approvals done in less than 60 days!!

This is not intended as legal, technical, or tax advice. Please speak with a licensed professional before making any decision. Information is deemed reliable but not guaranteed as of the date of writing.

You have the option to reject a short sale or loan modification from your lender if it does not meet your approval. If you decide not to go thru with the short sale, then you do not have to pay us our fee. We normally make a real estate sales commission for helping you on a short sale.
