Stop Foreclosure: Don't Be Embarrassed by a Westminster Short Sale!

Denver, CO – Short Sales are a situation that can often cause emotional turmoil as well as financial. It’s amazing how quick people are to judge others but times may be changing when it comes to today’s financial situations. We’re all feeling tough times. We all have seen local businesses close, people we know losing jobs they’ve had for years, and seen how the cost of living increases while the income we’re making doesn’t seem to be keeping the same pace.

Most of us don’t speak “legal-eze” and personally I’m thankful that most of us also don’t operate like some lenders. It’s hard to understand why a lender will jump at doing a Short Sale on a home as opposed to working with someone who’s done everything in their power to make right the situation they’ve ended up in, being overdue with the lender.

Many lenders somehow find it more logical to do a Short Sale than to work with the original owner and re-finance or negotiate terms that make it more reasonable for the owner to make regular payments again. Placing the overdue amounts at the end of your loan and putting you back on track seems more logical to you and I than taking a Short Sale. But then again, when does our logic seem to match the logic of most lenders?

What we have noticed though is that while we are all together in this financial mess of our economy we also seem to be more sympathetic and understanding about the situations of others. Friends and neighbors aren’t so quick to judge those who suddenly have a “Foreclosure” or “Short Sale” sign on their front lawn. People have become more sympathetic to those in their community who have been hit hard by hard times. There is no longer a scarlet letter worn by those who have hit hard times and find themselves having to give up their home via a Short Sale.

There is no shame in Short Sales. In most cases the home owners have approached their lender in every possible way, using every possible means to keep their home. Most lenders turn down every option other than literally snapping your fingers and coming up with all of the money owed instantly, no matter what the situation may be. These lenders should bear all of the shame for creating situations that don’t allow for a good, honest homeowner to maintain their dream.

A Short Sale is an option that is taken to help keep your dignity, sell your home, and have a fresh start. Many take this choice hoping to do less harm to their credit rating. Many times friends and neighbors will not only understand your situation but will respect that you’ve remained dignified through a terrible crisis in your life. Each of us understands that we are almost all only a paycheck away from being on the streets in today’s economy.

As we work together to make things better, one of the things we notice is that there truly is a lot less judging and finger pointing going on in life and a whole lot more understanding and help. The fingers are pointing to the lenders now instead.

Stop Foreclosure: Are the Big Banks Saving Money at Taxpayer's Expense?


Denver, CO – Many lenders do not own the loans they handle. Instead, they are paid by the actual loan owner to collect payment. They actually "service" the loan and receive a fee for that obligation. They handle the escrow accounts and collect payments.

Here are some horror stories that have occurred over a few years of dealing with short sales and the lenders.

In my opinion, the banks make millions by under staffing their foreclosure departments? Here's a real life example. A bank forecloses on a house and waits for over a year to list it for sale.

A year sitting in disrepair causes the home to sell for $30,000 less. But, the lender makes more money. Why? They might save $100 million by under staffing the department that handles delinquent properties.

Here are a few examples of how the owners of a loan lose money because the lenders don't do their job.

Example #1: Not giving buyers an answer on a short sale within one week. We took over a short sale from another agent. A buyer came along willing to pay 150k. They had been told they could buy it at that price for 150k, because the owner owed less than that.

When they found out it was a short sale they decided to walk. This was because they didn’t want to wait for 90 days. We told them they could buy it for 140k, if they waited for the 90 days.

They decided to stay on board. Wells Fargo accepted the short sale, but countered at a price of $141,500. The investor on the loan lost $8,500.

Example #2: Not following up on foreclosures properly. I drove past an abandoned house every day for a year. I looked up the owner to see if they might want to sell the house.

That’s when I saw that the home had been foreclosed on February 4th, 2009. In July 2009, we talked to Ann Rafferty at Bank of America’s, Simi Valley California office.

She told us that they were servicing this loan. She said if I had a buyer, I would need to contact the homeowner. “It’s not owned by us. You need to contact the homeowner if you want to sell the house. The property has not gone to foreclosure sale,” she said.

We told her the house had already been foreclosed upon. We asked her if they ever communicated with the foreclosure lawyers.

“That’s interesting,” she replied. “My records show it hasn’t gone to foreclosure. I’ll check in with the foreclosure department and verify whether it has or hasn’t been foreclosed upon.”

We asked another agent what he had thought the house would have sold for previously. We both agreed that if the house had been listed in April 2009, that it would have sold quickly for between $140,000 and $150,000.

Today homes similar to this one are selling for $70,000 to $80,000, depending on the condition. This home is in pretty bad condition. So, we can conservatively estimate the loss because of a reduced selling price to be more than $60,000.

As you can see, lenders are making huge profits at the loan owners expense. Many of those loans are owned or insured by Uncle Sam, and therefore the American Taxpayer. Remember those organizations like FannieMae and FreddieMac, and the taxpayer's dollars spent to BAIL them out??!!

Stop Foreclosure: Do Lender's Short Sale Negotiators Break The Rules?


Westminster CO – An agent with the Stop Foreclosure Institute recently had a short sale negotiator lie to them. We have spent the last 6 months figuring out all the rules for short sales on different loan types.

The rules are different for an FHA Short Sale, a VA Short Sale, and a Fannie Mae Short Sale. This was an FHA loan. Here's what happened.

FHA puts out a letter called "Mortgagee Letter 2008-43." It details exactly how the banks are suppose to handle a short sale on an FHA loan.

This letter is 16 pages long and gives them specific directions on how much to pay agents, what percentage of the appraisal they can accept, etc. (If you're doing an FHA short sale, then Google "Mortgage Letter 2008-43.")

This agent had had a wretched experience on another FHA short sale. The lender had lied to the seller's prior agent and hadn't followed the short sale guidelines.

Because of that experience, this agent had read thru the guidelines 2-3 times. Bottom line, I know a little bit about FHA's rules for short sales. The problem was this short sale negotiator didn't want to follow the rules!

Instead she made up her own rules! She told the agent that the buyer and seller had to split the cost of the title insurance. The problem is on page 12 of the Mortgage Letter, it says that they are allowed to approve a file paying the standard title insurance costs.

It was standard for the seller to pay for the title insurance. The buyer pays their closing costs and the title insurance for their lender. But, this negotiator didn't want to allow that.

The agent had to argue back and forth with her for 2-3 days until she finally relented. Here is the problem I have with these banks.

If your investor gives you specific instructions on how to negotiate a short sale, then follow those instructions! In this case, we agents need to get better at knowing the rules. That way, when an egotistical investor tries to break the rules, you can keep them in line.

If a negotiator is lying to you, then ask for their manager. When you talk to their manager, explain how they are breaking the rules.

Stop Foreclosure: Are Lenders So Desperate They Will Accept Any Offer?

Denver, CO – Have you heard the following myths about short sales?

Myth #1: You can buy short sales for dirt cheap and then turn around and resell them for a profit.

Myth #2: Foreclosures, Short Sales, and Bank Owned Homes can be bought for 30 to 50 cents on the dollar with no money down.

Myth #3: Lenders will accept any short sale offer even if it is for only 50% of what the home is worth. After all, they don’t want a foreclosure on their books.

These myths are just not true. Lenders are willing to foreclosure on properties. They have entire departments handle the sale of properties that they have foreclosed on.

Another foreclosure is nothing to fear. At the same time, they do prefer short sales. Short Sales are known to mitigate a lender's loss compared to a foreclosure!

They have high paid actuaries who have run the numbers and proved that to be the case. That means they take a pragmatic approach on short sales. In Colorado, our own MLS stats show that on the average a short sale would have netted the bank 8-18% MORE, than the foreclosed bank owned property does!

They want to make sure that the short sale offer isn’t lower than what the home would sell if they foreclosed on it. That is why they order an appraisal or a Broker's Price Opinion (BPO) before accepting the offer.

They won’t agree to a sale if the offer is for substantially less than the appraised value. We have been successful if the short sale offers have come in NO LESS than about 5-8% less than the bank's evaluations.

If it is substantially less, then they will ask the buyer to raise their offer to the appraised value.

Another thing lenders check before approving a short sale is that they aren’t approving a short sale for someone that is able to afford their home.

They don’t want to lose money on a short sale when they can make money when the person repays the loan.

Stop Foreclosure: Try Using a Buyer Letter to Short Sale Lender

Denver CO – If you are selling your home, then ask the buyer to write a letter about why they want to purchase the home. If you are a buyer, then write that letter.

The listing agent will submit that letter along with the short sale paperwork. With a little luck that letter will help “grease the wheels” and cause the short sale to be approved faster.

Short Sale negotiators are human beings. They have emotions that can be touched by a good story.

These letters might sound like a joke, but they can make a huge difference. I’ve even seen home owners lose money on their sale because the liked a certain buyer over another one.

In that case, the seller sold their home for several thousand dollars less to a buyer that they liked. The other buyer had been rude and the seller didn’t like them.

If that made a difference when the seller was losing their own money, then think about the difference it will make to a short sale negotiator who isn’t losing their own money.

Put a good story in your letter. Here are a few examples.

You might say something like this: “We are a first time home buyer looking for our first home. We just want to move out of our cramped apartment and are looking forward to our first home where we can plant a garden.”

Or, maybe it would be like this: “We have looked for a while and finally found this home on Elm Street that we love. We are selling our current home so we can buy a house with a yard.

Our two boys, Tim and Julian, have been begging us for a swing set. We never had room in our old condo.

If you approve our short sale offer, then we will finally be able to give them the large, fenced backyard they’ve always wanted with a swing set.

We’ve already picked out the swing set plan and Tim and Julian are so excited about it. So, don’t approve the short sale offer for us, approve it for them.”

See how I’m pulling the negotiator’s heartstrings. Unless your short sale negotiator is absolutely heartless, it will make a difference for you.

Stop Foreclosure: I Have A Moral Dilemma. What Should I Do?


Denver CO – The Stop Foreclosure Institute recently received a question from another agent named Beckie. Here was her question.

I have been waiting on my lender to approve or deny my short sale for 7 months. We finally received an answer last week in form of a counter offer to the price.

The buyer was offering to pay $315,000. The lender countered at $345,000. The buyer is not willing to pay any more than $315,000. My agent told him that he will try my best to negotiate at that price.

Before my agent could send the comps to the lender, the lender ordered an appraisal. My agent tells me that my property is worth more than $315k, but less than $345k.

So, we put the home back on the market just to prove to the lender that at that price there may be no bites. We were mistaken.

We received for $341,550. We told the first buyer if he goes up to what the lender wants, then we will close the deal with him. He didn't budge so we accepted the higher offer.

In the meanwhile, we received an email this morning from the short sale negotiator. She said that the lender will accept the $315k price. Now, my agent is suggesting that we do not submit the $26k higher offer, because that will rock the boat. I have a dilemma.

The first buyer's offer technically was accepted by the lender. I want to give it to him since he waited. But do we have an obligation to the lender to present the higher offer?

We accepted this second offer yesterday without a cancellation from the first buyer. The contract does give us an out. But now that the lender has agreed to the first buyer's price, do we need to sell it to him? HELP ! Beckie”

Here was our answer to Beckie’s Question. Beckie, I personally think that you are not morally required to submit the higher offer to BOA. But, that’s my personal opinion. In the past, we have had some of the large banks actually NOT take the higher value since they had already received approval from the investor on this particular loan.

In that case, it might have stopped the process with a new buyer, regardless of the price of the offer. Then you may lose BOTH buyers waiting for a new short sale approval. Yes, some lenders will assign a new negotiator and that will start the process all over!!

Now, in the case of your short sale offer, it was countered by the bank, at the $345k price. Your listing broker should have taken the OTHER offer since it was closer to the lender's counter! In my opinion, since there was NO short sale approval by the lender / investor, then that OPENED the door for more offers to be submitted for the short sale approval!!

Stop Foreclosure: Short Sale Question-Can My Lender Force Me To Repay Them?


Westminster CO – A lot of homeowners want to short sale and walk away from the upside down debt. They don’t feel that it is their fault the housing market crashed.

We get the following questions a lot.

“If I short sale, then how likely is it that my lender will sue me to repay them?”

“Will my lender garnish my wages or take money out of my bank account?” So I will answer those questions in today’s post.

The answer is that it is unlikely that any of that will happen.

Here is the #1 reason this usually doesn’t happen. About 65-70% of all short sale lenders will allow you to walk away owing nothing. The remaining lenders are usually too busy or disorganized to do anything.

Lawsuits cost money and they usually don’t get enough money back to justify the expense.

Here is the #2 reason this usually doesn’t happen. You can’t squeeze money out of someone who doesn’t have any money. The lenders know (from past experience) that if they push a debtor to hard, then that person will just declare bankruptcy.

So the lender gets no money anyways, but they lost money on the lawsuit and collection tactics. (Bankers don’t like to lose money.)

In addition, wage garnishment is difficult. There are many different exceptions and protections against wage garnishment.

For example, if the person being garnished is the main provider for a family, then the laws are often written to stop any garnishment against them.

This is why 80% of all judgments expire uncollected. Even though the legal system gives lenders lots of collection rights most judgments still expire unpaid.

Are You A Casualty Of The Terrible Loan Modification Process?

Westminster CO - I recently saw an amusing video about loan modifications. In it the guy called Wells Fargo "Hells Fargo." Apparently it is tough to get a loan modification. They lose your paperwork.

You have to talk to people in other countries where English IS NOT their first language. The people at the lenders treat you like dirt.

In addition, they pretend to love their customers. While you are waiting on hold for two hours to talk to someone, you get to hear the recording, "We at ABC Lending love our customers. We want to provide the best customer service in order to earn your business."

If you have experienced this, then you know how frustrating it is. But, why go thru the whole experience? Is it really worth the stress?

I don't think so. Most loan modification do not reduce your payment. Some do, but the reduction usually doesn't reduce the payment near the fair market rent. As a result, many homeowners limp along with a loan modification they can barely afford.

Little do they realize that they could go rent a similar home for less money. Here is one example of this. A homeowner gets a loan modification from her lender.

She borrows money from family for the upfront payment. Then, she suffers for a year while she pays a payment that is more than she can afford. She has to work extra hours and some night shifts.

Money is so tight she can barely afford to pay for food. Little does she know that she could rent a similar house for 30% less per month.

I see this story happen more often than not. People don't realize how competitive the rental market is today. They also don't know how much better off they will be mentally. If you are experiencing a loan modification horror story, then stop.

Take a look around. You do have options. There may be another home you and your family can rent. Then you can short sale, wipe out the upside down debt, and move on with your life.

Denver Loan Modification-Avoid This Mistake With Debt Collectors


Denver, CO- I heard about a guy who got ripped off by a debt collector.

The debt collector asked if he could pay them $500. He wanted to do the right thing. So he agreed to pay the $500. The debt collector sent him a form to make the payment thru his checking account. He filled out the form and signed off on it. The debt collector proceeded to completely drain his bank account.

They sucked out $1,800. This caused major financial problems for this guy. He couldn't afford gas to get to work. The reason that the debt collector was able to get the extra $1,300 was the fine print on the bottom of their form. The moral of the story? Never give any of your financial information to a debt collector or anyone.

If you do settle with a debt collector, only send them a payment where they can't track you. Use a money order. Money orders keep all of your bank account information private. You can buy one with cash or a debit card. The debt collector will never get your account information.

Never give any of your financial information to a debt collector. Do not send them info on your checking account, savings account, IRA, 401k, or any other financial account you have. Many state and federal laws often give a debt collector permission to take money out of your accounts, with or without your permission.

Unless you are a lawyer, you won't know if or when they can take money. So you are simply better off never giving them your info. The debt collection company that I mentioned above is based out of Colorado. I don't remember their name. They tried to collect from another person I know. They were very pushy. They only wanted his checking account info.

This tactic will apply with those trying to negotiate a Loan Modification, as well. If the lender asks for money up front to work the loan mod approval, DO NOT send them anything!!

Denver Short Sales: Remember Your Options To Stop Foreclosure


Denver, CO - If you're facing foreclosure, then you are probably under stress. You don't know what is going to happen. How long will it take before the bank kicks us out on the street? Will I owe my lender a ton of money? Will I ever get my life back? That's why we put this site together. You need to know what your options are. So, let's go thru them here.

Option #1: Do nothing and the lender forecloses on the house. Please be aware that in most states the foreclosure process can take a long time. I've seen it take some lenders up to a year to foreclose on a house. Some banks have better lawyers and can get a foreclosure done in 3-4 months. But, that is often rare.

Option #2: Deed-In-Lieu of Foreclosure. A "Deed-in-Lieu" is where you surrender your home to the lender. This enables the lender to sell your home faster and protect their investment. What benefit does it give you? None. Do not consider this option unless the lender gives you something in return

Option #3: Loan Modification to reduce your mortgage payment. If you want to keep your home, then it is a good option. Many lenders will reduce your interest rate, or extend the term of the loan. To qualify, you often have to send your lender all of your pay stubs, bank statements, and other financial documentation. Click here to get more information on this option.

Option #4: Reinstatement. This is when you pay the lender for all back payments, late fees, and other related costs. After that you start making normal monthly payments. This restores your account to its former current status. The only problem is that it requires you to come up with all the back payments and other fees.

Option #5: Get a New Loan and pay off your old loan. This is a good option if you still have equity in your home. However, if you owe more than your home is worth, then it will be hard to find a lender willing to pay everyone off. The other problem is that when your credit history shows late payments, then it will be hard to get a new loan.

Option #6: Sell the property. If you don't want to your house anymore, then this is a good option to consider. However, if you owe more on the mortgage than the house is worth, then you will need to sell thru a short sale.

Option #7: Rent the property. This is a good way to earn some extra money. However, many mortgages are written with legal clauses that force you to forward any rent proceeds to the lender. In addition, many local and state governments have recently written laws forbidding you form renting a property unless the mortgage is current.

Option #8: Bankruptcy. This used to be a great option for a fresh start. However, in recent years the bankruptcy laws were tightened up considerably. The law now forces the bankruptcy judges to steer you to a Chapter 13 bankruptcy. This is versus the better bankruptcy option, which is a Chapter 7. The difference between the two is that a Chapter 7 gets rid of all your debts. A Chapter 13 basically sets you up on a court monitored repayment plan.

Under a Chapter 13, many people find themselves stuck under the same burden of debt that caused the problem in the first place. Only this time, they have to pay all the extra costs associated with the bankruptcy. I've heard some experts say that your just better of not paying your creditors than doing a Chapter 13 bankruptcy. This costs you less money out of pocket and your credit gets cleaned up faster.

Option #9: Short Sale. A short sale is when you owe more than your home is worth. You sell it with the assistance of a licensed real estate agent. It costs you nothing. The agent gets paid by your lender. It is well known that a lender will net more money on a short sale than taking a home back thru foreclosure. Why? A lender saves money on interest, attorney fees, and other related foreclosure costs.

A recent study done by the Boston Consulting Group showed that a lender will reduce their losses considerably with a short sale. If you are interested in a short sale, then fill out your info at the bottom of the page. In fact, they reduce their losses by 20% on average when accepting a short sale versus foreclosure.

Here is what we do when we help you with a short sale.

Step #1: We put the home up for sale and market it to find a buyer.

Step #2: We gather all of the necessary documents to process the short sale.

Step #3: After we find a buyer who wants to purchase the property, we contact your lender’s loss mitigation department. We ask them what documents are necessary to submit the short sale package and how to send it to them.

Step #4: We submit the buyer’s offer and all the short sale paperwork to your lender. We have a complete checklist that we follow so everything is submitted properly.

Step #5: We follow up with your lender to negotiate the short sale. There is a lot of time involved at this stage of the process. Many lenders short sale departments are busy with an avalanche of file. However, with a little patience and perseverance we are able to get the lender to approve the short sale.

Step #6: Upon lender approval we then coordinate everything to a successful closing. We follow up with all the inspections, appraisals, surveys, and the buyer’s financing.

Step #7: Closing. Everything is completed and you are now out from under the burden of debt and stress. Most sellers are so glad to be done with the stress and uncertainty. It’s closure.

Denver Loan Mod Help: Why Lenders Back Off When Threatened With Bankruptcy

The lenders know that most bankruptcies will cause them to lose the ability to pursue you for any losses. This means they can’t go after you for any upside down debt.

The only thing a lender gets in a Chapter 7 Bankruptcy is any collateral they have on a loan. So they can foreclose on your house, but that is about the only thing they can do. There can be NO recourse for the deficiency or outstanding debt!

They can’t garnish your wages or bank accounts. So use the bankruptcy threat in your negotiations. Lenders know how much it will hurt their ability to collect from you.

The most effective technique that we have seen is to have all negotiations go thru a bankruptcy lawyer. The lawyer knows how to negotiate from a position of power.

The lawyer will also know full well exactly how bankruptcy will hurt the lender. Even if you have no intention of declaring bankruptcy the lender will get scared and cave in.

Then you can get the loan modification you deserve.

Don’t Make This Mistake On Your Denver Loan Modification



Denver– If you're trying to get a loan modification, then you have think like a banker. How you present your finances is the key to success.

You’ve got to show them an income that’s not too high and not too low. If you show them too low of an income, they’re going to go “Oh, this guy can’t afford his house payment.

If we reduce his payment to $800, he won’t even be able to afford it anyway so what’s the point in reducing it? Before, he thought he could pay $1,200 a month. He can’t even pay the $800 a month that’s he’s asking for today. He's not making enough money, based on our ratios, to be able to afford it.”

Here's what happens if your income is too high. Let's say your payment is only $1,000 a month and you’re making $4,000, $5,000, or $6,000 a month. They will say “What’s up with this? This guy’s making a ton of money. Why are we going to reduce his payment?”

So you’ve got to make sure your income and your budget is in that middle range. Look at your recent income history.

Maybe you can pull the most recent month. If it shows the right numbers use it. Or, pull from a longer period. Use the last three months or the last six months worth of income. Maybe even use

You want to be able to demonstrate that you're making enough money to afford that payment, but not making so much money that they will charge you more.

How To Get Your Loan Mod Approved When Negotiating With A Local, Denver Lender


Westminster CO - In my opinion, loan mods are very tough to negotiate with large lenders like Bank of America, Wells Fargo, JP Morgan Chase, or SunTrust. The reason is because you are treated like a number.

In addition, in most cases the lender doesn’t own your loan. Someone else does. So when they negotiate with you, it is simply to go thru the motions. They are MORE interesting in what they can COLLECT from you!

No, common sense does not apply in these situations! The good news is that common sense does apply when you are dealing with a small, local lender.

I remember hearing a credit union in my town run ads about how they didn’t treat you like a number.

The ads said something like, “When you bank with X Credit Union you aren’t a number. We talk to you on a first name basis.” I didn’t see the benefit then, but I do see it now.

I talked with a recent homeowner about how he negotiated a loan modification with a small, local lender. At first the lender played total hardball with him.

“Either pay us in full or we will foreclose”, they told him. They were firm on being paid in full. The said if he didn’t pay they would file foreclosure right away.

He was paid in full for a while. Six months later he grew tired of being dead broke (which is how his finances were after giving his lender most of his earnings every month.)

So he decided to “play chicken” with his lender. He stopped paying. His lender continued to play hardball. Finally, he consulted a bankruptcy attorney and had them take over the negotiations with his lender.

The lender backed off. They total changed their tune. No longer were they playing hardball. Now, they wanted to “work something out with him.”

Wow! What a difference that one simple thing made. Notice he didn’t have to file bankruptcy or anything.

But, the threat caused them to change their tune. In my next blog post I’ll explain why.
