Stop Foreclosure: Your Options To Avoid Foreclosure in Denver!

Denver, CO- With the recent influx of homes hitting the new foreclosure lists in the Denver area, I thought it would be a good time to post this reminder of Your options to avoid foreclosure!

Option #1: Do nothing and the lender forecloses on the house. Please be aware that in most states the foreclosure process can take a long time. I've seen it take some lenders up to a year to foreclose on a house. In Colorado, the is an accelerated foreclosure process and can happen 111-120 days after foreclosure notice has been recorded.

Option #2: Deed-In-Lieu of Foreclosure. A "Deed-in-Lieu" is where you surrender your home to the lender. This enables the lender to sell your home faster and protect their investment. What benefit does it give you? None. Do not consider this option unless the lender gives you something in return!

Option #3: Loan Modification to reduce your mortgage payment. If you want to keep your home, then it is a good option. Many lenders will reduce your interest rate, or extend the term of the loan. To qualify, you often have to send your lender all of your pay stubs, bank statements, and other financial documentation. Request your FREE copy, below!!



Option #4: Reinstatement. This is when you pay the lender for all back payments, late fees, and other related costs. After that you start making normal monthly payments. This restores your account to its former current status. The only problem is that it requires you to come up with all the back payments and other fees.

Option #5: Get a New Loan and pay off your old loan. This is a good option if you still have equity in your home. However, if you owe more than your home is worth, then it will be hard to find a lender willing to pay everyone off. The other problem is that when your credit history shows late payments, then it will be hard to get a new loan.

Option #6: Sell the property. If you don't want to your house anymore, then this is a good option to consider. However, if you owe more on the mortgage than the house is worth, then you will need to sell thru a short sale.

Option #7: Rent the property. This is a good way to earn some extra money. However, many mortgages are written with legal clauses that force you to forward any rent proceeds to the lender. In addition, many local and state governments have recently written laws forbidding you form renting a property unless the mortgage is current.

Option #8: Bankruptcy. This used to be a great option for a fresh start. However, in recent years the bankruptcy laws were tightened up considerably. The law now forces the bankruptcy judges to steer you to a Chapter 13 bankruptcy. This is versus the better bankruptcy option, which is a Chapter 7. The difference between the two is that a Chapter 7 gets rid of all your debts. A Chapter 13 basically sets you up on a court monitored repayment plan.

Under a Chapter 13, many people find themselves stuck under the same burden of debt that caused the problem in the first place. Only this time, they have to pay all the extra costs associated with the bankruptcy. I've heard some experts say that your just better of not paying your creditors than doing a Chapter 13 bankruptcy. This costs you less money out of pocket and your credit gets cleaned up faster.

Option #9: Short Sale. A short sale is when you owe more than your home is worth. You sell it with the assistance of a licensed real estate agent. It costs you nothing. The agent gets paid by your lender. It is well known that a lender will net more money on a short sale than taking a home back thru foreclosure. Why? A lender saves money on interest, attorney fees, and other related foreclosure costs.

A recent study done by the Boston Consulting Group showed that a lender will reduce their losses considerably with a short sale. If you are interested in a short sale, then fill out your info at the bottom of the page. In fact, they reduce their losses by 20% on average when accepting a short sale versus foreclosure.

Short Sale Your Denver Home and Worried Lender Might Foreclosure On It First?


Westminster CO – Short sales can drag out. It takes 1-2 months to sell the house. If longer, you may need to implement periodic price reductions to encourage offers! Then, the short sale negotiations start.

They can drag out for 3-6 months. In the meantime, if you aren’t paying on the mortgage, then the lender will be trying to foreclose on the house.

Here is the best solution. Have a good complete short sale package and a legitimate offer into the lender to negotiate the postponing of the foreclosure sale date. In Colorado, we still find this to be the better way of getting the sale date postponed! Since, we have an accelerated foreclosure process that takes place 110-120 days after recording!

In another state, here is an extreme example that one real estate agent had his seller do.

"Here is what I had to do. In the case of looming foreclosure sale date then, I get the owner to go to the courthouse and file a petition with the foreclosure judge", Alberto said.

(The owner is the only one allowed to do this. I think the actual legal term is a motion.)

"The seller will be asked to go to a hearing with the judge. The owner goes to the room where the judge is holding session. They sign in and wait to be called.

The owner will be only one allowed to speak and they must explain the situation. The owner explains that there is an offer on the property and that they need some time for the lender to process the short sale."

I always recommend that the seller take copies of everything to show the judge. They bring the sales contract and the buyer’s loan approval.

Most of the time, the judge will grant their request and extend the foreclosure sale date by 90 days. The only exceptions are when it has been postponed several times already.

This may not work in all situations, but was successful for Alberto. Discover what lenders will NOT postpone the sale date, and you may have to use this approach!

Denver Short Sales: Why Should I Short Sale?

Westminster CO – We often get asked if a short sale is even worth the effort. “Why don’t I just let the bank have the property”, sellers tell us. “I don’t ever think I’ll be able to fix my credit to be able to buy another house.”

When you are having a tough time financially, it may seem like you will never get back on your feet. But, most people do get back on their feet.

They find another job and start making money again. Their credit will usually be back to normal in 2-3 years.

Why not buy a new home at that time? If you short sale, then you will be eligible to do that. Fannie Mae will consider you for a new loan 2 years after a short sale.

You would have to meet all of their credit guidelines and other lending criteria. Most derogatory credit items such as late payments or collections won’t have as much of an impact when they are 2 years old.

In addition, there are many ways to get derogatory items removed from your credit. The other great option is an FHA loan. FHA allows you to buy a home with only 3.5% down.

Current FHA guidelines will loan to you 3 years after a short sale and a foreclosure, but the foreclosure will stay on your credit 7-10 yrs! This credit "derogatory" may impact other things, i.e: job employment, credit ratings, etc. Not to mention the "outstanding debt" and "deficiencies" that still are in place, after a foreclosure!

<strong>That is the number one benefit of a short sale.</strong> You can get back on your feet and buy another home a lot faster than if the lender forecloses on your home. Thinking about a short sale?

A Common Denver Short Sale Marketing Mistake: Not Promoting Unique Properties to Buyers Looking For Unique Properties


Westminster CO – Unique properties usually have a "love it" or "hate it" aspect to them. A great example is pool homers.

Some buyers want a home with a pool. They are willing to spend $20,000 to $50,000 more for a home with a pool. Other buyers absolutely do not want a pool.

"Don't show me any pool homes", they tell their agent. If those buyers are not going to like the pool home once they see it, then what is the use trying to hide it.

Show it off. That is why a pool home should be marketed loud and clear as a "pool home." The same goes for other unique properties, such as waterfront properties.

Another good example is a home that backs up to a power line. A power line is a huge negative for most buyers. But, it is a big plus to other buyers.

I heard a story about a home that backed up to power lines. The sellers had a hard time selling it. They finally hired an agent that knew a certain home buyer would like it.

The perfect buyer for that home is a family that loves ATVS. They could ride their ATVs on the power line easement.

Most roads and neighborhoods are unfriendly to ATV riders. The power line gave them miles of trails to ride without being harassed.

A third example is homes located down a dirt road. These homes appeal to people with horses because the dirt road is a great place to ride a horse.

They don't appeal to people without horses (who wants to live down a dirt road?) This is why a home down a dirt road needs to be marketed to horse owners.

If you have a unique home, then you need an agent who can market it properly. More than likely, your home's unique features need to be proclaimed loud and clear. It's ALL in the marketing of unique properties!

In a few other cases, they don't. A good, experienced realtor will know what to do.

The lenders know that most bankruptcies will cause them to lose the ability to pursue you for any losses. This means they can’t go after you for any upside down debt.

The only thing a lender gets in a Chapter 7 Bankruptcy is any collateral they have on a loan. So they can foreclose on your house, but that is about the only thing they can do. There can be NO recourse for the deficiency or outstanding debt!

They can’t garnish your wages or bank accounts. So use the bankruptcy threat in your negotiations. Lenders know how much it will hurt their ability to collect from you.

The most effective technique that we have seen is to have all negotiations go thru a bankruptcy lawyer. The lawyer knows how to negotiate from a position of power.

The lawyer will also know full well exactly how bankruptcy will hurt the lender. Even if you have no intention of declaring bankruptcy the lender will get scared and cave in.

Then you can get the loan modification you deserve.

Westminster Short Sale Question: How Is Short Selling A Rental Different From Your Personal House?

"How is the short sale process different for a homeowner versus a rental property? Is the owner of a rental property more likely to have a deficiency judgment and/or be taxed on the deficiency than someone short selling their own primary residence? Brett."

Here was our answer to Brett's question. Yes, the short sale of a property that was acquired as a rental, will have different consequences than a primary residence short sale.

(The scenarios below are for a property you bought as a rental, not a property you bought to live in and then started to rent out.)

1. Deficiency. In most cases, you will not be dealing with the lenders who will allow you to walk away from the debt. Lenders are going to ask for a promissory note or deficiency much more often on a rental.

You can still short sell without a deficiency, but it won't be as easy to do it.

2. You are more likely to owe income taxes. Uncle Sam isn't giving you the same break on cancellation of debt income waiver that a normal homeowner gets.

Check with your accountant on methods that can help you wipe out even this debt.

A Common Denver Short Sale Negotiation Mistake: Not Properly Working the First Offer


Westminster CO – Many times you will feel pressure to reply right away to an offer. But, that doesn’t mean that you shouldn’t negotiate to obtain an offer that you feel will satisfy the short sale lender(s).

Buyers are impatient and if they really like your house, then they will want an answer to their offer right away. They are hoping to lock you in with their offer before another offer comes in. Since, you are required to have the contract subject to the seller's short sale lender(s), you may not be locked in, anyway.

It also means they are probably willing to pay more for your property. Take the time to talk to your short sale broker. You need to take a little time and consider whether or not you should counter the price or other terms of that first offer.

In some cases, the first offer's price may not be the driving factor, as much as time is. Too often, sellers do not get their home on the market until after foreclosure notice has been given. You may NEED that first offer to present to the lender to negotiate the foreclosure sale date postponement.

Understand what pressure you may have to yield to in order to get the right offer that you and your short sale broker will believe will satisfy the lender's BPO or appraisal values.

Denver Loan Mod Question: How Do I Get A Loan Mod On An FHA Loan?


Westminster CO - The Stop Foreclosure recently received a question from Grant. Here was his question.

"I have an FHA loan and want to get a loan modification. My bank is playing hardball and won't modify the loan at all. My friend got a loan modification and said it was pretty easy. What can I do to modify my loan?" Grant.

Here is the answer. I don't know the specific rules for FHA Loan Modifications. But, I do know how to find them. Here is what I have learned about FHA Loan Modifications and FHA Short Sales.

The FHA Program takes the loss on any short sales or loan modifications. Because of that they get to make the decisions on how loan mods and short sales are implemented.

The FHA program is administered by the Federal Department of Housing and Urban Development. Most people call it "HUD." HUD has specific employees that administer the FHA Loan Program.

Those employees do not review loan modifications or short sales themselves. Instead, they give specific written instructions to the lenders that handle the loans.

These specific instructions are called Mortgagee Letters. If the lender wants to be reimbursed for any loss by the FHA Insurance, then they must follow the instructions.

They issue updates to their directions regularly with new Mortgagee Letters.

Here is the bottom line. Your lender has to follow those written instructions. The good news is that you and I can access and read thru these letters online.

To find out the specific rules for an FHA Loan Modification, you will have to read thru the following Mortgagee Letters. Mortgagee Letter 2009-35, Mortgagee Letter 2000-05, Mortgagee Letter 2002-17, Mortgagee Letter 2008-21, Mortgagee Letter 2010-11, and Mortgagee Letter 2009-23.

I just found some good information in Mortgagee Letter 2002-17. "At no time shall the loan be considered delinquent solely because the borrower has not paid late fees or other foreclosure costs."

I have seen lenders put a borrower into default status and charge late fees on late fees. One late fee can blossom into thousands of dollars in charges. It looks like FHA doesn't like that practice.

There are probably a total of 40-50 pages that you will need to read thru. But, because you know the rules you will have the upper hand in any negotiations with your lender.

I think that is worth spending a little extra time reading thru everything.

Should I Loan Mod or Short Sale My Denver Investment Property

Here was Kristine’s Question. “I bought a condo in 2005 and have never been late on a payment. My husband and I have been renting out this property for less than we pay on it.

We had hoped that the market would turn around, which it hasn't. The current renter has fallen behind on rent in July and will be moving out at the end of the month.

In turn we are struggling to pay our own bills. We have done all we can to keep our finances afloat. But, it has gotten to the point that our savings are drained and we cannot afford this condo anymore.

I heard that doing a short sale may be in good interest for someone in my situation. The loan I have is a VA loan and I hope I will not mess my future VA loan privileges up by doing this.

However, we simply cannot afford to pay our current mortgage and all of our bills with this condo hanging over us. Please let me know what you recommend that we do. Kristine.”

Here was our recommendation to Kristine. A short sale would be beneficial to you. Let me explain why.

Currently you are losing money every month. In addition, the economy has caused you to use up all of your savings. But, this condo is still costing you money every month.

If you short sale it, then you will not have to repay VA or your lender any money for the loss. However, you will not be able to get another VA loan in the future until you repay VA for the loss.

Here is the bigger issue. A VA loan gets you a half a percent better interest rate. If you get another loan for $200,000, then that will save you $20,000 over the life of the loan

I do know that the area you bought your condo has experienced significant depreciation. Your condo has dropped in value by $120,000.

I would prefer to write down $120,000 in debt and take the temporary credit hit. Your alternative is to continue limping along losing money each month until you miss enough payments that the bank forecloses on your condo.

Step Three In Fixing The Flawed Denver Short Sale Process: Accountability


Westminster CO – Once the lenders have solid data in place to find and measure the problem, then solid decisions can be made to fix the problems. Our last blog post detailed how to get that data.

Once you have the data, then you can have accountability. Here are a few things we know should be held more accountable.

#1: People that value the property for the lenders. Before approving a loan modification or short sale, the lenders compare that financial result with what they can expect from foreclosure. What they will recoup on the short sale or loan modification is a relatively solid number. What they will recoup on foreclosure is not.

So, they ask an expert to tell them what the property is worth. This person evaluates the property and tells the lender what they think the property is worth. (BPO-Broker Price Opinion or an Appraisal)

In our opinion, these valuations are not always accurate. We see many people say a property is worth $240,000. The short sale offer is for $225,000 and is rejected because of the $15,000 difference.

However, when the property is foreclosed and the dust settles, the home ends up selling for $200,000. That is a big discrepancy and someone needs to be held accountable for it.

#2: The people processing these files. In some cases, the people processing these files don’t answer calls or respond to e-mails, in a timely manner, due to the over load of files on their desk. Because of this, many short sales fail and are foreclosed on later.

If a buyer offering to pay $225,000 walks after two months and the home sells for $200,000 as a foreclosure, then the person processing the short sale needs to be held accountable.

Brokers Claim the Denver Short Sale Process Is Flawed. But, How Do We Fix It?

Some of the brokers complained that they are “struggling with a broken short sale process.” But, why is the short sale process flawed?

Because no one is checking the results. There is no stated goal for the process. Have you ever heard of the first step in overcoming alcoholism?

In Alcoholics Anonymous, the first thing a new member does is admit they are an alcoholic. The new member stands up and says, “Hi, I’m Tom and I am an alcoholic.”

At that point they have established the problem and acknowledged its existence. Now they have a clear goal to overcome. Back to short sales.

Have the bank’s established a problem?

Maybe the CEO could stand up says, “Hi, I’m Brian. The bank I head up is losing billions of dollars on bad loans.” In addition, the people invested in our loans are losing billions more.

Finally the American Homeowner is losing billions from a declining housing market caused by abandoned and unloved foreclosures being tossed on the market with no regard for preserving home values.”

The Final Numbers On How A Denver Short Sale Reduces Losses

Westminster CO – On our last blog post, we ran some numbers on why a short sale reduces a lender's losses by 20% compared to a foreclosure.

Today I am going to add all the numbers together. That way we can see exactly how much this lender lost by not accepting the short sale.

I am using the real life example of a short sale that was listed for sale for $425,000. The lender turned down an offers for $385,000 and ended up selling the home for $230,000.

Let's add up the costs.

$155,000 in sales price loss. ($385,000 minus $230,000.)

$30,318.75 in lost interest income. ($385,000 lent at 4.5% interest over 21 months.)

$11,411.89 in property taxes that would have been paid by the short sale buyer, but instead were paid by the lender. ($6,521.08 annual property taxes over 21 months.)

$3,000 in estimated foreclosure costs. (This is to pay the foreclosure attorney and the court costs.)

$4,200 in Homeowner's Insurance. ($200 monthly times 21 months.)

$203,930.60 in total lost because they didn't accept the short sale offer. Ouch! I don't care how rich you are (or how many bailouts you received), that is a lot of money.

Yes, these numbers are correct. Real estate is an expensive business. It costs a lot of money to own and maintain a house.

Just look at how much you spend on your mortgage, property taxes, homeowner's insurance, maintaining your house, and mowing your yard. Now multiply that by 21 months. Make sense?

Another Westminster Short Sale Myth: Lenders Are Dragging Their Feet On Short Sales And Waiting On A Bailout

Westminster CO – The Stop Foreclosure Institute recently received a question from Josh. Here was his question.

"I heard that a short sale reduces a lender's loss by 20% compared to a foreclosure. You would think that would make them excited to work on my short sale. But, they are dragging their feet.

My lender isn't that excited to work on my short sale. I think they are waiting for another bailout. Do you think that is true? Josh."

Here is the answer to his question and some insight into what is really happening at the lenders. I think at the beginning of the recession the lenders were waiting for a bailout.

But, after that the real slowdown was that they are simply understaffed. In 2007 very few people were short selling their house. The lenders didn't need a lot of people to process the few short sales. Fast forward 2 years. Short sale volume probably multiplied by ten times or more.

But, it takes time to hire and train more staff. Short sales aren't simple. There are lots of guidelines and laws regulating them. A new staff person can't just show up and start processing files tomorrow.

More than anything else this has slowed down the short sale process. So, do the lenders like short sales? The CEO does because it cuts the lender's losses.

But, the employee who has watched his file law quadruple probably doesn't like short sales. He is having a hard time coping with the extra workload.

How To Preserve Your Credit During A Westminster Short Sale

Westminster CO – If the right decision for you and your family is to sell the house as a short sale, then the sale will have an immediate effect on your credit score.

You might feel like it’s just overwhelming and demoralizing to see your credit score take any more hits!

But, here’s the silver lining: according to most experts, 78% of Americans have ERRORS on their credit score. Why is that a silver lining?

If you have negative errors on your report that get fixed, that will be a benefit to your score.

Average people can, on their own, take steps to repair and restore their credit report/ credit score after a short sale.

Here is how to avoid any double whammies during and after your short sale.

Follow these simple steps.

1. Review your credit report. I recommend the site: https://www.annualcreditreport.com/cra/index.jsp.

Do not go to any of those “free credit report” sites. After you get the report, review everything on it.

If you see anything that is negative, inaccurate, or questionable make a note of it. On your list, write down why you disagree with that item on your report.

2. Write letters to the different credit bureaus about what you are disputing on your report. There are several sample letters available online: http://www.creditinfocenter.com/forms.

Here is a simple tip: DO NOT use the online dispute forms that are on the websites of the 3 credit reporting agencies. Write your own letter and make it short, firm, and demanding of action.

3. Mail your letters to the credit bureaus through either registered or certified mail. This is what sets the clock for them to correct issues.

The law lays out a time line that they have to follow (45 days.) And, this gives you a record of the mailing, too.

4. Keep a file of all that you have done, including dates. Then, track your results, also.

5. When you’ve gotten back responses (or if 45 days pass and you haven’t gotten responses), then it’s time to repeat some of the process again for some item or another on your report.

If you are diligent and proactive, you might just surprise yourself by the benefits you can see in on your credit report – even after your short sale! Thinking about a short sale?
