A Mental Breakdown or What?

  Westminster, CO -  Every now and then you get a strange request from a homeowner that finds your blog and needs to inquire about the short sale process!
Now, that's a good thing!!  We certainly want to assist someone that has a real estate need.

 A few weeks ago, I was approached via my email in regards to how a short sale works.  After a few emails back and forth to discover exactly why this homeowner was need of a short sale, and especially since it was ON THE MARKET, with another local real estate broker, she asked that I call her and come to her home.

With that invitation from the Seller, we proceeded and met to discuss and review all the real estate docs.  Prior to my visit, the homeowner requested the current real estate broker to stop marketing her home.  NOW, we all know what that really means to a real estate brokerage firm.... and we go on to discover what the heck is going on here. 

Once, I had the opportunity to review the current MLS of this property information and the documentation of the real estate docs, we have come to the conclusion that there HAD to be a real mistake during this process of marketing the home.

The current DEBT on the property was about equal to the value it had been placed on the market!!  Which means, that the homeowner would have to either, bring money to the table or negotiate a short pay-off (short sale) with the lenders!  There is a 1st and 2nd lien on this property.

The Title company had notified the homeowner that based on the current debt and selling costs, their estimated NET (Not so sure why this information was not disclosed to the Seller by the real estate broker - like during the CMA presentation), she would need to bring funds in excess of $11,000!!

SEARCH FOR HOMES IN WESTMINSTER, COLORADO UNDER $300,000!!

This of course has created a great concern from the Seller, and recognizes that she would be in a short sale situation!!  This was never addressed with her by the current real estate broker, nor are there any addendums (short sale addendum) addressing the shortage of funds to sell!

The Title company had provided her the information 3 weeks into the marketing process!! 

It appears that someone had NOT done their due diligence in listing this property, possibly by performing a proper O & E search you would have had a better understanding,  and if they had... why was this NEVER discussed with the homeowner??

Based on the real estate docs that the Seller had signed and had copies of, nothing discloses this short pay-off situation!!  The property has been withdrawn from the MLS!!

We shall see where this "sad situation" ends up!!

Stop Foreclosure: Short Sale Success From Realtor Using Our Strategies!

Denver, CO – It is important to have the right tools in place to negotiate the short sales in today's environment. Here is an email from another Realtor that had incorporated some of our strategies.

"I sent an email to the lender on a short sale, utilizing the e-mail address list you provided. The email was sent at 1:43 p.m. this afternoon. I received the Short Sale Closing Approval at 5:38 p.m. this evening. No promissory notes and no deficiency judgement. Keep up the fight and thanks again for all you guys are doing! Karen.”

Our techniques work to help short sale sellers walk away without promissory notes or deficiency judgments. I wish I received approval letters that quick after sending an e-mail!

We have received them in 2-3 days, but not in a single afternoon. It is great to know that you can do the right things to make the banks be responsive!

Let's be honest, this is NOT the rule but more of an exception. This Realtor's email had certainly reached the right management to finalize this situation with a very acceptable result!

We appreciate hearing about how other Realtors have incorporated strategies that have made their sellers resolve their real estate problem with satisfactory success!

Westminster Short Sales: What can go bad on a short sale when you hire an agent that doesn't understand short sales

Westminster CO – It always amazes me when I hear the stories of agents who talk about horrible short sales are. "Don't waste your time on a short sale", they tell homeowners.

"They are a waste of time. The lenders won't approve them and the process is horrible. The last short sale I worked on took 9 months", they say.

<strong>This gives short sales a bad name. Homeowners mistakenly believe that a short sale is impossible</strong>. I am here to tell you that is not true.

The Stop Foreclosure Institute has sold and closed many short sales. There are two keys to being successful. First, you have to understand how the process works. Second, you have to keep an eye on the transaction from start to finish.

<strong>Here is the closest comparison I can think of on why some agents hate short sales.</strong> Let's say that you are a brand new driver.

You hop into a car, accelerate to 70 miles per hours, turn on cruise control, and then start reading a book. Every 5 minutes or so you look up to check on what is going on with your car.

You aren't successful at driving a car. Your friend is thinking about learning how to drive. "Don't even think about driving a car. Driving just doesn't work and it is impossible to get anywhere", you tell them.

<strong>Is what you just said correct?</strong> Is driving a car impossible? No, it's not! But, many agents make the same claim about short sales.

<strong>They have never studied and learned the process.</strong> They have never successfully sold a short sale. But, they are sure ready to tell you that it doesn't work.

<strong>Here is what they missed about short sales. </strong>

<strong>1. You need to be knowledgeable about the process.</strong> You need to have a solid understanding of HUD-1s, BPOs, and the short sale guidelines of the entity that owns or insures the loan.

<strong>2. You have to stick with the transaction.</strong> You need to follow up with the short sale lender regularly. You can't check in on the short sale every week or two. A lender will often ask for something and want it back within 24 hours.

If they don't get what they need, then they will close the file. If you agent isn't checking in regularly, then the short sale file could be closed without their knowledge.

In addition, your agent needs to be able to make sure the HUD-1s and BPOs are accurate. I will explain what those acronyms mean and why they are important in my next post.
