Disclosure of Working Relationships

Denver, CO - Wow, what a strange day for me while working a showing on an office listing, yesterday.

I happen to be in the office when a call came in from a prospective buyer, wanting to view a property in the prestigious community of Legacy Ridge. After, interviewing the buyer with my normal questions and inquiries, i.e: are you currently working with a broker, have you been to a lender for pre-approval, and so forth, I decided to meet with them later in the afternoon.

I met with one of the buyers, who showed up 10 minutes late, and once I greeted her, I asked her to review a disclosure document that explains the "working relationships" we have in Colorado. Of course, she was very curious as to what this was all about.

I proceeded to explain the purpose of the disclosure document and she proceeded to argue with me that she was not signing anything or commit to anything. Then the other buyer, her boyfriend showed up, and after introductions, I asked him to review the document and I proceeded to explain the purpose of this, again.

I explained to both of the buyers this is ONLY a disclosure doc, NOT a contract, which it states in the form, and that they are getting way ahead of any kind of commitment or obligation to anyone.

I was absolutely surprised and the reluctance to review and acknowledge that I have presented this document and explained the working relationships. Both argued with me that they did not want to be obligated to anyone. Then was reminded by both of them, that they have looked at numerous properties and have NEVER been asked to review this document or had this explained to them by any other broker.

Needless to say, I found this unacceptable and told them so, and said that I am being up front and honest with them about the importance of knowing how the real estate broker works and represents you. I mean, it is only required that ALL real estate brokers present THIS document before showing homes, by the Colorado real estate commission.

So, after about 10 minutes of the explaining WHY I do this, and told them they could view the property but I wanted them to sign the document or write across it that they refuse to sign. At least I fulfilled my obligation of presenting it before viewing any property with me.

Of course, they refused and walked out of the property!

This action just drives me nuts. First off, why OTHER real estate brokers ARE NOT fulfilling their obligations with informing the general public about working relationships as required by our real estate commission. I call it LAZINESS, and the fear of taking the time to explain it!

Secondly, I do use this process to determine if the information I have received over the phone was INDEED correct or not. What I mean from this, is... are they in fact working with someone OR have intents to work with another broker they have in mind?

I believe that the reluctance to sign a DISCLOSURE doc, satisfies my mind that they indeed have someone else, and just did not bother to be up front with me.

Now, to work this process into my phone conversation, first!!
Do you think other real estate brokers will do their disclosure obligations up front, too??

You Have to Love the Colorado Weather!

Living close to the MILE HIGH CITY of Denver, Colorado, we tend to get use to the "roller coaster" ride when it comes to the weather. Being 5,280 feet above sea level, it is easy to witness and get use to the changing weather in a 24 hour period.

Some folks jokingly state, "Hang around for 24 hours and the weather will change, 2 or 3 seasons!"

In January, it is a special time for entertainment in Denver. Not just the skiing, in the mountains west of Denver, but the Rodeo and Livestock Auctions that we all have come to know and love, called the Stock Show!

Every year in January, we have our version of the rodeo, and with that we seem to always have the "Arctic Blast" from Canada with cooler temperatures. Seems this year is NO exception. The Stock Show started this last Sunday, and will continue for 2 weeks.

Now, yesterday, we had weather in the 60 degree range, and this morning the cool and wet weather came in around 5am, with temps dropping from 40 to 28 in less than an hour.

Ok... so do we wear a sweater and shorts (based on yesterday, YES), or a parka and gloves (based on a change in less than 12 hours) YIPEEEEE ... we love it, here!!

Do not MISS your opportunity to visit the Mile High City, even if you are the Fans of an opposing football team!!



We do realize that we take for granted the gorgeous sunrises this time of year, in Colorado.




One thing about this type of weather... the ski resorts and the mountain ranges love this snow for recreation and water supply!!!

Stop Foreclosure: Reminder for Mortgage Debt Forgiveness, HB3648!

Denver,CO – We are moving into the last year of the Mortgage Debt Forgiveness Bill, HB3648, that was put into place by the Bush Administration and extended by Obama's until Dec. 20th, 2012.

One of the important issues of this HB, is that it allowed for the home loan borrowers to protect themselves from the "TAX Liability" on any deficiencies or outstanding debts incurred due to a short sale process.

Understand that it MAY NOT protect ALL home loan borrowers from the "tax liability", such as an investor that borrowed the funds to PURCHASE an investment property. You might need more assistance from your tax accountant to determine this.

Stop Foreclosure: Learn The Foreclosure Process in Your State!

Denver,CO – How often do you work with a listing broker of a short sale that does NOT quite understand the timeline in their foreclosure process?

This happens way too much! Thus, causing some uncertainty in getting the short sale approval from the bank when less than 30 days from the foreclosure sale date.

In Colorado, we do have an accelerated foreclosure process than a lot of states in the Union. We have worked with other listing brokers that DID NOT pay attention to the timeline OR did not use it for their advantage when negotiating the short sale with the lender(s).

Keep these factors in mind:

1) Some lenders / investors will NOT postpone the foreclosure sale date!

2) There are certain circumstances when less than 90 days from the foreclosure sale date, the HAFA program will be denied, so do NOT waste your time trying to work it!

3) Placing the property on the market with less than 30 days from the foreclosure sale date may be a loss effort! Search to find out what lenders / investors will postpone with a buyer contract in hand and those that will not postpone, regardless of a buyer contract in place.

4) Learn how the short sale lender postpones the foreclosure sale date, and for how long and how many times. (Most will do it for 30 days and at least 2 times). Knowing this may allow you to get a proper buyer contract in place to negotiate the short sale.

Understanding the timeline for a foreclosure sale will help you in becoming a better real estate Advocate for you clients!
