How Do I Stop The Foreclosure Process During A Denver Short Sale?

“I am in the middle of the 3rd offer on a short sale. I was just recently received foreclosure papers. Is there a way to stop the foreclosure process and get the house sold? If they just would work with me! Trudi”

Here is the answer to Trudi’s Question. Unfortunately, most banks won't stop foreclosure proceedings. Most of the time, they will stop a foreclosure sale when you have the following in place: short sale package and a contract from a legitimate buyer!

For example, we saw a lender stop a sale last year. The sale was set for around September 7th and the property was listed around August 25th. This is unusual, and it really depends on the owner of the note, lender or investor such as FannieMae or FreddieMac.

A Common Westminster Short Sale Marketing Mistake: Your Realtor Doesn't Make Sure That Your Home Shows Well


Westminster CO – When another agent brings a buyer to look at your home your realtor should follow up afterwards to obtain any valuable feedback from that agent.

Again, the purpose of feedback is to find out what buyers think of your home. If you want to sell your home, then it needs to show well. Here are a few tips.

1. Open the blinds and curtains. Bring in as much outside light as possible. Most showings happen during the day, whether during the week or on the weekend.

Turn on as many lights as possible. Buyers want to buy an open and bright home. They don't want a "cave."

Sure, they will turn the home into a "cave" after they buy it. They will have the blinds closed most of the time. They will install curtains and never let any natural light into the house.

But, that doesn't mean they want to buy a "cave." Yes, I know it's crazy. I guess it's just human nature at work.

2. Your home should be clean, tidy, and well groomed. Fix anything that doesn't look right. If your sidewalk is black from algae, then pressure wash it off. Put new mulch in the front flower beds.

3. If you have a good sense for decorating, then decorate! Make your decorating neutral enough that most people will like it, and remove all your personal items, like family pictures! If you have an empty room, then rent some furniture and put it in there. Try to stage it!

Buyers have a hard time imagining if their furniture will fit in a room. They usually think that they need more room than they actually do.

If they can see furniture already there, then it helps bridge that gap. They can see for themselves that their furniture will fit.

4. Get the carpets cleaned. If your carpet is old, but you can't afford to replace it, then hire a good steam cleaner. Ask someone who manages an apartment complex for a referral.

Most apartment complexes know a carpet cleaner that can get the so called "impossible stains" out of carpet.

The only thing a lender gets in a Chapter 7 Bankruptcy is any collateral they have on a loan. So they can foreclose on your house, but that is about the only thing they can do. There can be NO recourse for the deficiency or outstanding debt!

They can’t garnish your wages or bank accounts. So use the bankruptcy threat in your negotiations. Lenders know how much it will hurt their ability to collect from you.

The most effective technique that we have seen is to have all negotiations go thru a bankruptcy lawyer. The lawyer knows how to negotiate from a position of power.

The lawyer will also know full well exactly how bankruptcy will hurt the lender. Even if you have no intention of declaring bankruptcy the lender will get scared and cave in.

Then you can get the loan modification you deserve.

They need to get feedback on what the buyer/selling broker thought of your home. If the buyer liked your home, then they will ask if they are thinking of making an offer.

Too often, the feedback we get on our short sale listings comes across as this, "This buyer feels the property has too much work to do", or "They do not have the extra funds to correct the necessary repairs, so they must move on".

This is a common concern. So, it makes you wonder if the buyer's broker is consulting with them about the nature of short sales. Also, the fact of these short sale listings are being strictly sold "As-Is". Meaning, the seller will never provide seller concessions for repairs or price reductions based on a buyer's inspection.

Thus, the buyer will have to correct or replace any deficiencies on the property, with their own sweat and funds. Which brings me to this concern about buyer's agents preparing their buyers to acquire short sales.

All buyers should be counseled about the types of financing that is available to them for such things as short sales and bank owned properties that will require work to be done to satisfy their living requirements.

FHA 203K, Rehab loan, is a great finance tool for short sales. We have worked these type of loans for short sales and they handle the concerns for the work that is required, i.e.: new windows, new roof, new HVAC systems, or required repairs for loan conditions.

If your realtor follows up, then they can handle those concerns and get a buyer off the fence and convince them to buy your home.

Denver Short Sales: Why Should I Short Sale?

Westminster CO – We often get asked if a short sale is even worth the effort. “Why don’t I just let the bank have the property”, sellers tell us. “I don’t ever think I’ll be able to fix my credit to be able to buy another house.”

When you are having a tough time financially, it may seem like you will never get back on your feet. But, most people do get back on their feet.

They find another job and start making money again. Their credit will usually be back to normal in 2-3 years.

Why not buy a new home at that time? If you short sale, then you will be eligible to do that. Fannie Mae will consider you for a new loan 2 years after a short sale.

You would have to meet all of their credit guidelines and other lending criteria. Most derogatory credit items such as late payments or collections won’t have as much of an impact when they are 2 years old.

In addition, there are many ways to get derogatory items removed from your credit. The other great option is an FHA loan. FHA allows you to buy a home with only 3.5% down.

Current FHA guidelines will loan to you 3 years after a short sale and a foreclosure, but the foreclosure will stay on your credit 7-10 yrs! This credit "derogatory" may impact other things, i.e: job employment, credit ratings, etc. Not to mention the "outstanding debt" and "deficiencies" that still are in place, after a foreclosure!

Denver Loan Modification: Don't allow your lender to take advantage of you

Many people think you will have a better opportunity of getting a loan modification if you pay up some of your back payments. It all depends on who you are talking to at your lender. When you first get behind on your payments, you will be dealing with the collections department. In my opinion, these people will tell you anything, just to get you to pay a dime. Let me explain.

Their job is to collect as much money as possible. It's in the lender's best interest to get you to pay them anything. They don't want to approve a loan modification until they absolutely have to. Loan modifications mean they have to hire on more employees. That costs money. Not good for the balance sheet.

They want everyone behind on payments to catch up. If they can do that without a loan modification, then great. They just want to get payments coming in. "Just get people to pay anything. The more the better", the managers say.

Most lenders take a month or longer to even look at your loan modification file. They can't approve a loan modification until someone processes the file. In the meantime, the collection people are still calling. Those collections people want to get paid. But, they are trying to get money before your loan modification even has a chance of getting looked at. This is why you have a better chance of getting a solid loan modification when you are behind on payments.

A Common Denver Short Sale Marketing Mistake: Not Promoting Unique Properties to Buyers Looking For Unique Properties


Westminster CO – Unique properties usually have a "love it" or "hate it" aspect to them. A great example is pool homers.

Some buyers want a home with a pool. They are willing to spend $20,000 to $50,000 more for a home with a pool. Other buyers absolutely do not want a pool.

"Don't show me any pool homes", they tell their agent. If those buyers are not going to like the pool home once they see it, then what is the use trying to hide it.

Show it off. That is why a pool home should be marketed loud and clear as a "pool home." The same goes for other unique properties, such as waterfront properties.

Another good example is a home that backs up to a power line. A power line is a huge negative for most buyers. But, it is a big plus to other buyers.

I heard a story about a home that backed up to power lines. The sellers had a hard time selling it. They finally hired an agent that knew a certain home buyer would like it.

The perfect buyer for that home is a family that loves ATVS. They could ride their ATVs on the power line easement.

Most roads and neighborhoods are unfriendly to ATV riders. The power line gave them miles of trails to ride without being harassed.

A third example is homes located down a dirt road. These homes appeal to people with horses because the dirt road is a great place to ride a horse.

They don't appeal to people without horses (who wants to live down a dirt road?) This is why a home down a dirt road needs to be marketed to horse owners.

If you have a unique home, then you need an agent who can market it properly. More than likely, your home's unique features need to be proclaimed loud and clear. It's ALL in the marketing of unique properties!

In a few other cases, they don't. A good, experienced realtor will know what to do.

A Common Denver Short Sale Marketing Mistake: Not Marketing Short Sale Listings to Prospective Buyers


Westminster CO – Here is a quick story that illustrates this point. An agent I know was hired to sell a 30 acre tract of land that was a short sale.

Several months earlier they had spoken with a buyer that was looking for a similar property, but that agent had never talked to the buyer about short sale listings.

However, the buyer had said they were looking for something closer into town, and never thought about looking at short sales. So while consulting with those buyers, this broker did not cover the benefit of buying a short sale listing. Never assume that a buyer is not interested in acquiring a short sale!!

The buyer had discovered this short sale listing when inquiring about other properties with a different broker, and decided to investigate this property and ended up being the buyer of the 30 acre listing.

In this case, the seller was fortunate that the property sold. But, it illustrates the importance of a realtor marketing their homes to their active buyers.

Those buyers already know and trust that realtor. They are the most likely prospects to buy the homes that agent has for sale. Provide the information and let the buyer make the decision of whether or NOT they would entertain buying a short sale listing.

A Common Denver Short Sale Marketing Mistake: Not Using the MLS Properly


Westminster CO – This MLS Mistake could cause the right buyer to never look at your home in the first place. The Multiple Listing Service (MLS) is the first place an agent representing a buyer is going to look for homes for sale.

(The Multiple Listing Service, which I will call MLS for short, is the database of homes for sale that all realtors in a certain area share, and communicate how they will co-op with each other in buyer / seller transactions.

When an broker has a buyer and their own homes for sale won't fit that buyer's needs, then they search the MLS for all properties listed by other brokers.

If another broker has a home that fits that buyer's needs, then they can sell the other broker's listing.)

In today's market agents have a lot of homes to pick from. Ten, twenty, thirty, and sometimes even a hundred homes fit their buyer's criteria. But, they will usually only show that buyer 5-7 homes at one time.

If these agents don't pick your home from their MLS search, then you just missed a potential buyer. Here are a few reasons that certain homes get skipped over in the MLS search.

Reason #1: The main picture of the house is ugly or unattractive. The agents are usually scanning thru lots of listings and don't have time to look at all the pictures.

If the main picture is unattractive, then they will pass on showing the home. We use a youtube video to showcase our listings, are your listing broker's doing that?

Reason #2: The property is put into the MLS wrong. For example, many MLSs have a search function for the size of the lot.

The agent puts in 0 acres for the lot size. The house will not show up when an agent searches for a lot size between .5 acres and 1 acre.

Nor will it show up in any other search that has a specific lot size. This might not be a big deal if you don't have a lot with a bigger than normal yard.

But, I can tell you from specific experience that this will hurt your sale if you have a larger than normal lot. There are many other MLS mistakes, but this is a specific example to show you how it can affect you.

Reason #3: You don't price your home at $25,000 increments. Most buyers use $25,000 increments when searching online. Pricing it right, even as a short sale, will encourage buyer traffic.

For example, they will search for a home priced between $200,000 and $250,000. If your home is priced at $250,000, then it will show up in multiple searches.

A $250,000 home will show up in a search for homes priced $200,000 - $250,000 and a search for homes priced $250,000 - $300,000.

This increases the likelihood of the right buyer seeing your home in the search results and therefore the likelihood of your home selling.

A Common Misconception: Denver Buyers Don’t Like Short Sales

Westminster Short Sales: Does ABC Bank Really Care About Their Customers?


Westminster CO – Doesn't it annoy you when you hear a large national bank's hold music tell you that they care about their customers?

Their hold music sings their praises: "We are (Insert your bank's name) appreciate your business. We offer the best customer service in an effort to earn your business."

If you ever feel we are not upholding the standard of excellence in customer service, then please let us know", it says.

Arrrrggggghhhhh!!!!! I hate that! If you have ever negotiated a short sale or loan modification with a large lender, then you will understand what I am talking about.

They all talk the talk, but they don't walk the walk. Excuse me, but waiting on hold for 30 minutes does not count for excellent customer service.

Losing my short sale paperwork for the tenth time doesn't qualify either. Nor do the loan mod horror stories I hear from sellers who have finally given up. Banks, please get your act together!

Fortunately, we can still get short sales approved, despite the bad customer service. This causes some agents to avoid short sales, but it doesn't stop us.

Don’t Make This Mistake On Your Denver Loan Modification



Denver– If you're trying to get a loan modification, then you have think like a banker. How you present your finances is the key to success.

You’ve got to show them an income that’s not too high and not too low. If you show them too low of an income, they’re going to go “Oh, this guy can’t afford his house payment.

If we reduce his payment to $800, he won’t even be able to afford it anyway so what’s the point in reducing it? Before, he thought he could pay $1,200 a month. He can’t even pay the $800 a month that’s he’s asking for today. He's not making enough money, based on our ratios, to be able to afford it.”

Here's what happens if your income is too high. Let's say your payment is only $1,000 a month and you’re making $4,000, $5,000, or $6,000 a month. They will say “What’s up with this? This guy’s making a ton of money. Why are we going to reduce his payment?”

So you’ve got to make sure your income and your budget is in that middle range. Look at your recent income history.

Maybe you can pull the most recent month. If it shows the right numbers use it. Or, pull from a longer period. Use the last three months or the last six months worth of income. Maybe even use

You want to be able to demonstrate that you're making enough money to afford that payment, but not making so much money that they will charge you more.

Westminster Short Sale Question: How Is Short Selling A Rental Different From Your Personal House?


Westminster CO – The Stop Foreclosure Institute recently received a question from Brett. Here was Brett's question.

"How is the short sale process different for a homeowner versus a rental property? Is the owner of a rental property more likely to have a deficiency judgment and/or be taxed on the deficiency than someone short selling their own primary residence? Brett."

Here was our answer to Brett's question. Yes, the short sale of a property that was acquired as a rental, will have different consequences than a primary residence short sale.

(The scenarios below are for a property you bought as a rental, not a property you bought to live in and then started to rent out.)

1. Deficiency. In most cases, you will not be dealing with the lenders who will allow you to walk away from the debt. Lenders are going to ask for a promissory note or deficiency much more often on a rental.

You can still short sell without a deficiency, but it won't be as easy to do it.

2. You are more likely to owe income taxes. Uncle Sam isn't giving you the same break on cancellation of debt income waiver that a normal homeowner gets.

Check with your accountant on methods that can help you wipe out even this debt.

How To Get Your Loan Mod Approved When Negotiating With A Local, Denver Lender


Westminster CO - In my opinion, loan mods are very tough to negotiate with large lenders like Bank of America, Wells Fargo, JP Morgan Chase, or SunTrust. The reason is because you are treated like a number.

In addition, in most cases the lender doesn’t own your loan. Someone else does. So when they negotiate with you, it is simply to go thru the motions. They are MORE interesting in what they can COLLECT from you!

No, common sense does not apply in these situations! The good news is that common sense does apply when you are dealing with a small, local lender.

I remember hearing a credit union in my town run ads about how they didn’t treat you like a number.

The ads said something like, “When you bank with X Credit Union you aren’t a number. We talk to you on a first name basis.” I didn’t see the benefit then, but I do see it now.

I talked with a recent homeowner about how he negotiated a loan modification with a small, local lender. At first the lender played total hardball with him.

“Either pay us in full or we will foreclose”, they told him. They were firm on being paid in full. The said if he didn’t pay they would file foreclosure right away.

He was paid in full for a while. Six months later he grew tired of being dead broke (which is how his finances were after giving his lender most of his earnings every month.)

So he decided to “play chicken” with his lender. He stopped paying. His lender continued to play hardball. Finally, he consulted a bankruptcy attorney and had them take over the negotiations with his lender.

The lender backed off. They total changed their tune. No longer were they playing hardball. Now, they wanted to “work something out with him.”

Wow! What a difference that one simple thing made. Notice he didn’t have to file bankruptcy or anything.

But, the threat caused them to change their tune. In my next blog post I’ll explain why.

Denver Short Sale Question: Should I Short Sale My Rental?


Westminster CO – The Stop Foreclosure Institute recently received a question from Ryan. Here was Ryan's question.

"I own a rental house. When I bought it, the rent covered the mortgage and all the other payments. However, rental rates have declined in my area and the rent no longer covers the mortgage.

Besides that, I had to write a big check to fix the roof and carpet. i am sick of the money drain. Also, I am now upside down because the housing market has taken a dive here.

Can I short sale this house? I am concerned that if I do, then my lender will come chasing me for the loss. Let me know what you think. Ryan."

Here was our answer to Ryan's question. Ryan, we do think you should try a short sale on the house.

It sounds like the only thing holding you back is wondering whether or not you will have to repay the bank for the loss. We think you have a better than 50% chance at not repaying them a dime.

In addition, you can probably negotiate that amount down. For example, a homeowner we recently helped had to repay $20,000 when the bank lost over $120,000.

That is right. They wiped out a $120,000 debt for only $20,000. Besides, they had 10 years to repay that $20,000.

However, when you compare the interest they would have repaid on that $120,000, they saved even more (close to $193,000 after you add in interest.)

So try out a short sale. With a little creativity and the right person negotiating for you, you have a good chance at walking away from that monthly cash drain.
