Denver Short Sales: What Do Lenders Consider A Legitimate Hardship For A Short Sale?


Westminster CO –We had a question about FHA short sales yesterday. We did some research on FHA short sales as a result. We stumbled upon something interesting.

We have a list of all of the things that FHA considers legitimate hardships for a short sale. Click here to view the actual list from FHA. The good news is that if FHA considers something a hardship, then it is likely that most lenders agree.

Here is the list of things that FHA thinks are a legitimate hardship for a short sale.

* Death of Principal Mortgagor.

* Illness of Principal Mortgagor.

* Illness of Mortgagor's Family Member. Extraordinary medical expenses are part of the equation.

* Death of Mortgagor's Family Member. Extraordinary expenses are part of the rational.

* Marital Difficulties.

* Reduction in income.

* Excessive Obligations. No loss of income. To quote FHA, "The delinquency is attributable to the mortgagors(s) having incurred excessive debts(either in a single instance or as a matter of habit) that prevent him or her from making payments on both those debts and the mortgage debt."

Job Transfer.

* A Problem with the property such as poor quality construction, expensive repairs being needed, etc.

* Inability to Rent Property.

* Military Service where the person can't afford their house because their paycheck won't enable them to cover the payment.

* Unemployment / Job Loss.

* Business failure.

* High Energy Costs. Your income and everything else stays the same, but your utility bill shoots thru the roof. To quote FHA, "All other factors remained the same, but sharp increase in utility cost(s) deferred funds that would have been available for the mortgage payment or costs associated with the removal of environmental hazards in, or near the property."

* Payment Adjustment. To quote FHA, "Delinquency began after either increase in P&I for ARM mortgage or after escrow analysis where one or more escrow item increased, including the spreading of the amount needed to repay an escrow shortage over the next year."

* Incarceration.

A Common Westminster Short Sale Myth: Banks Can't Write Off Too Much Loss At Once



Westminster CO – We at the Stop Foreclosure Institute receive emails all the time that go something like this “The Bank’s Short Sale Problems are not that simple.

A bank can’t afford to write off too much loss at once. Also, their investors may not approve the short sale, because they can’t afford to write off too much loss at once either. And the circle goes on. Thank you, Amy

Here is why this flawed assumption is incorrect. Most of the large, national banks do not own the mortgages they handle.

As an example, Bank of America does not own 80% of the mortgages they service. The biggest holders are the GSEs: Fannie Mae, Freddie Mac, and Ginnie Mae.

These entities are accustomed to losses. The other entity that’s set up well and accustomed to losses is FHA.

Most of the remaining loans are owned by Wall Street Firms, Pension Funds, and other professional investors. Most of the loans owned by them have already been written down in value dramatically.

In a few, isolated instances, the “We don’t want to write off losses to fast because it will hurt this quarter’s earnings” thing applies. First, off any bank CEO that plays this game should be fired.

It’s illegal because of accounting rules. Not writing off losses that you know about could be considered insider trading by many.

Besides, when you push the loss on non-performing loans to the future, the losses are bigger in most cases. Any prudent person would agree that making losses bigger by pushing them to the future is bad business.

The bigger problem is that the lenders don’t have enough staff to process the files. They need short sale negotiators to submit files to the owners of the loans.

As an example, on a recent FHA short sale, the negotiator told us it would take her 2-3 weeks to review the offer and then submit it to FHA.

However, she did tell me that FHA only has a 72 hour turnaround from when she submits the file to them. That is pathetic.

Here is why the lender doesn’t have any incentive to hire on more staff. On that file, the lender isn’t losing the money, FHA is losing it.

Therefore why should the lender spend money to hire on more staff? There is no incentive to do so.

Westminster Short Sales: How To Look At A Short Sale From The Lender’s Perspective



Westminster CO – The Stop Foreclosure Institute received a few responses from yesterday’s blog post. Most of the questions went something like this.

“I think a lender would be stupid to approve an investment property short sale for a wealthy person. If I was the lender I would sue them for the loss!”

The bottom line is that people didn’t think a lender would allow a wealthy person to walk away from the debt on an investment property.

Here are a few reasons why a lender will allow a wealthy investor to walk away from an upside down investment property.

Lenders know that if they can give a customer what they want, then it will help them. If they don’t give a customer what they want, then everything turns into a fight.

Some homeowners will hire a lawyer to review every clause in the mortgage. They will check to make sure that each clause of the mortgage meets every single conceivable state and federal law. Some of the investigating an attorney will do is called, “Forensic auditing”. This may lead to a bigger issue for the lender, when these loans get sold over and over again to investors, and the original documents get lost or misplaced. It will place a lot of pressure on the lenders / investors to negotiate the short sale to avoid law suits!!

Other people will declare bankruptcy to avoid paying the debt. This is the biggest impediment keeping lenders from collecting on a debt.

Debt is very hard to collect even in court. In fact, only around 8-10% of all judgments are ever collected. That means a lot of people and lenders spend thousands of dollars in court getting a judgment, only to never collect the money.

This is one of the reasons that a debt collection company recently bought $20 Million Dollars worth of Deficiency Judgments for $150,000. I don’t know which lender sold them, but apparently that is all they thought they were worth.

I hope this helps you see why a lender would find it simpler to approve a short sale rather than pursuing a debtor in the hopes of collecting on the deficiency.

Little does the average American know that the banks are flubbing it. In my opinion, the biggest mistake that banks are making is rejecting profitable loan modifications.

They would net more money on a loan modification than foreclosure. However, because the loan modification process is so tough they are foreclosing instead.

Most Americans would agree that it is important to help homeowners stay in the home. They agree even more when they learn how it would help the bank’s bottom line and the general economy.
Keep this in mind if your lender rejects you loan modification and forecloses on your home. Most Americans would disagree with that when it causes a homeowner to lose their home and the bank to lose more money.

The banks can claim that they “followed all the guidelines.” They think that is their “get out of jail free” card.

However, it is hard to explain that when they lose $60,000 as a result of “following all the guidelines.” Anyone would agree that guidelines can be stretched when $60,000 is on the line.

The average American will be more appalled when they realize the damage this is causing to general housing market and the economy.

So let’s educate the public on this. Let them know what is happening. Then the loan modification process will become easier and more people will be able to keep their homes.

Westminster Loan Mod Help: Hold Your Lender Accountable When They Reject Your Loan Mod & Lose Money


Westminster CO – In my opinion, the decision making process most lenders use to approve or deny a loan modification is flawed. It appears that the lenders have one thing in mind when you stop paying.

They want to foreclose as quickly as possible. It appears that they don’t want homeowners to stay in the home. Foreclosure is much simpler and easier. So they just look at it as the main solution.

If a homeowner can’t afford the payments, then the lender should have reducing losses as their main goal. If that was their goal, then they would approve loan modifications that net them more money than a foreclosure would net them.

Instead, the loan mods are approved only when everything is perfect. As a result, you have people that would find a way to make the payment being foreclosed upon.

As an example, let’s say a homeowner could afford a mortgage payment that equals a $200,000 mortgage. But, the borrower doesn’t completely match the lender’s guidelines.

So the lender forecloses on the house. It sells for $140,000. That is $60,000 lower than the $200,000 they would have netted on the loan modification. Ouch!

That is how you can hold your lender accountable. If they reject your loan modification and foreclose, then you should track what your home sells for after foreclosure.

But, how does this help you during loan modification negotiations? Tell the loan mod negotiator that you plan on holding them accountable.

Tell them that you will contact your newspaper and all the large, national newspapers. I’m sure the media would love the story.

The loan mod negotiator knows this is true and will work harder to find a way to approve your loan modification. They don’t want their name in the newspaper.

Don’t Make This Mistake On Your Westminster Loan Modification


Westminster CO – If you’re trying to get a loan modification, then you have think like a banker. How you present your finances is the key to success.

You’ve got to show them an income that’s not too high and not too low. If you show them too low of an income, they’re going to go “Oh, this guy can’t afford his house payment.

If we reduce his payment to $800, he won’t even be able to afford it anyway so what’s the point in reducing it? Before, he thought he could pay $1,200 a month. He can’t even pay the $800 a month that’s he’s asking for today. He’s not making enough money, based on our ratios, to be able to afford it.”

Here’s what happens if your income is too high. Let’s say your payment is only $1,000 a month and you’re making $4,000, $5,000, or $6,000 a month. They will say “What’s up with this? This guy’s making a ton of money. Why are we going to reduce his payment?” In other words, they WILL NOT approve a loan modification.

So you’ve got to make sure your income and your budget is in that middle range. Look at your recent income history.

Maybe you can pull the most recent month. If it shows the right numbers use it. Or, pull from a longer period. Use the last three months or the last six months worth of income. In most cases, the lender will want the recent history.

You want to be able to demonstrate that you’re making enough money to afford that payment, but not making so much money that they will charge you more.

Another strategy to use when negotiating a Westminster Loan Modification

Westminster CO – Lenders hate losing money. They hate loan modifications, principal reductions, and any other thing that causes them to lose money.
But, in today’s tough economy they have no choice but to accept them. The primary reason a lender will grant a loan modification is because that usually reduces their losses.

If they foreclosed on the house instead, then the losses would be larger. Besides most foreclosures take 18-24 months and often longer.
(That alone should convince you that their losses will be larger after a foreclosure.)
Use this to your benefit when negotiating a loan modification. Hire a real estate broker to tell you what your house is worth. Then, show your lender that value.
Now, add in all the costs that you can think they will incur if they foreclose on your home. Below are some examples costs.
Current Market Value: $300,000.
Lost Interest income at 5% over two years. $30,000.
Property Taxes over two years: $6,000.
Home Insurance costs for two years: $3,000.
Projected Net from a foreclosure: $261,000.
Because the lender can clearly see how much money they will use, it make it much easier to negotiate a reasonable loan modification.
