Stop Foreclosure: Escalate To An Investor On A Denver Short Sale!

Denver, CO – The Stop Foreclosure Institute recently received an email from Mercedes. Here was her question.

“I need your help on how to escalate a file with Chase. Twelve months and still Chase claims the loan owner, Freddie Mac, will not help with buyer's closing costs, wants a $36,000 promissory note or $15,000 cash from seller at closing!!

The buyer is willing to pay 4-5 thousand at closing and Chase claims Freddie Mac refused to accept that? I don't believe they would rather foreclose and lose more money." Mercedes.

Here was our answer to her question. Freddie Mac will normally pay buyer’s closing costs up to 3% of the sales price.

They have approved it on every single Freddie Mac file when the buyer needed it. In my experience, most Freddie Mac files have Private Mortgage Insurance, aka PMI.

PMI is probably asking for the $36,000, not Freddie Mac. If there is no PMI, then Chase is negotiating too hard. If that is the case, then contact Freddie direct.

Stop Foreclosure: Are Banks Polluting The Economy?

Denver, CO – Very few people disagree that banks are not handling the housing crisis properly. Why is it so hard to get a reasonable loan modification?

Pollution is defined as the following by Wikipedia: "Pollution can be a simple example of market failure. If costs of pollution from a factory are not borne by the factory owner, but instead are borne by the workers or people in the community, then prices are distorted."

Basically, the factory can pollute at will. Now, let’s take the same sentence and change it to banks.

"Negligence and incompetence can be a simple example of market failure. If a $180,000 loss on a single house are not borne by ABC National Bank, but are borne by Fannie Mae and the American Public, then the decision making process is distorted."

Over 80% of all loans that major banks have are not owned by the banks. That could be used to argue that the banks are polluting the economy at will.

Stop Foreclosure: Why Does a Bank Pay the Realtor in a Short Sale?


Westminster CO – The Stop Foreclosure Institute recently received a question from Charlene. Here was her question.

“I am thinking about short selling my house. I’m just wondering how I can get someone to help me. I know that your website says that a short sale costs me nothing. I just have a hard time understanding why my lender would pay you if they are losing money. Please explain that. Charlene.”

Here was our answer to her question. We will try to keep it simple in answering her question. Banks are not allowed to be in the business as their own brokerage firm to sell real estate. It is a conflict of interest since they are the ones that generate loans and financing for real estate. It would be defined as a monopoly on the real estate industry, and thus avoids the possibility of discriminating at their whim!

Thus, they must hire a real estate brokerage firm to sell their bank owned properties, so why not the brokerage firm at the short sale process, and with a savings.

The bank does benefit greatly to pay a real estate brokerage firm during the short sale rather than 8-12 months later when they own it after foreclosure! This is because they get to sell the house at today's price, versus what it will be worth down the road. I just did a comparison and pulled up sold homes.

All of the homes were very similar, in style, location, and all terms. First, I looked up the average selling price per SQ FT of homes that sold in 6-8 months ago. They sold for an average of $103 a SQ FT.

Then, I pulled up houses in the same neighborhoods that sold after the bank had foreclosed on them. Those sales were in the last 2 months. They are sold for an average of $85 a SQ FT.

These homes average 1,700 a SQ FT. That means a 1,700 bank foreclosure sold for $30,600 less. Ouch! As you can see, a short sale realtor brings tremendous amount of value to the bank.

You also benefit. Your credit damage is reduced. You also, have a lower chance of being chased down for the bank’s losses. A short sale is a win - win for everyone involved.

Stop Forelcosure: Two Lenders Are Fighting Over the Money!


Westminster CO – The Stop Foreclosure Institute recently received a question from another agent named Bonnie. Here was her question.

“On my short sale, the first mortgage gave me a price and a net they would allow. The title company put together the closing documents and paid the first more than the minimum net they needed.

Then, I offered the second mortgage what ended up being 12% of their loan. They are owed 76K, I offered 9600. Here is the problem. Now, they want 15K and are saying that is their final offer.

I do not think the first will allow them to receive that much. The first is HSBC. Do you have any suggestions on this one?

What would have been a better approach...offer to the 2nd on a different HUD a smaller amount to start? I used the same HUD to present to both, getting the firsts approval first. Bonnie.”

The first would see a closing statement with 20k going to the 2nd. Meanwhile the 2nd would get a closing statement with 3k and more money going to the first.

Robert Ringer, in his book Winning Thru Intimidation, talks about this problem. He was working as a mortgage broker on a hard money loan for a development.

He had to juggle the lender bringing money to the table and what the developer would net at closing. Plus, he had to make some money for himself in the middle. What did he do?

He started out telling the lender he needed to grant a big loan and told the borrower he was getting less money. He juggled those two and ended up making some money in the middle.

Here is what you can you do to close this short sale. This 2nd mortgage negotiator is being unreasonable. Escalate the file, show them the MLS history, and remind them that they get zero in a foreclosure.

Show them the docket status for the foreclosure case. If the house is close to foreclosure, you gain more negotiating power. Another thing to do is get both of the negotiators on the phone.

Have them hash it out between each other. That worked for us on a deal before and it might work for you too.

Stop Foreclosure: Lender Won’t Approve The Short Sale. What Should I Do?


Westminster CO – The Stop Foreclosure Institute recently received a question from another agent named Sylvia. Here was her question.

“Here's a question for you. I have a short sale with two offers. The appraisal was close to the sales price and the inspection was good.

However, the bank calls me and says, “Sorry, you can’t short sale the house because this is a "recourse" loan for 5 years.” I did some research and the loan is owned by Fannie Mae.

The sellers received foreclosure papers a week later. Fannie Mae says that the lender can approve the short sale. But, the lender says they can’t without Fannie Mae’s permission.

Needless to say, I am confused. Any thoughts on how this could have a happy ending? Sylvia.”

Here was our answer to Sylvia’s Question. Sylvia, I understand the frustration! I believe the negotiator at GMAC is being very lazy. They are NOT investigating the solution with the investor, Fannie Mae.

In their attempt to try and collect more money, rather than to get this done, NOW, they are NOT communicating with their investor. I’ve never heard of anything like this happening.

You are being lied to. Call the lender’s short sale phone number and ask to speak to a supervisor!

Then, ask them: “Are you someone who can speak with authority and actually knows what they’re talking about when it comes to Fannie Mae Short Sale Guidelines?”

If that person can’t speak with authority, then ask for the manager of the loss mitigation department. Tell that person the situation and ask them what is going on. That should solve the problem.

Stop Foreclosure: The Biggest Threat To A Successful Denver Short Sale


Westminster CO – The biggest threat to your short sale is a high appraisal that Banks will consider for short sale properties due to economic reasons.

A bank will approve a short sale only if they think they will net more money taking the short sale offer. To make sure they aren't selling the house for too little, they order an appraisal.

The problem is that most homes are selling for less than the appraisals. In one example, a listing sold for $225k, that was neither a short sale or bank owned. However, the property could have appraised for $300k, based on some recent comps that were short sales.

That means the short sale lender would never have approved it. This is why your short sale agent needs to make sure to price the short sale property based on good actual SOLD comps. Your broker needs to provide that information to the appraiser to assist them in determining market value, based on the offers. There is nothing unethical or illegal about doing this. Let me explain why.

80% of the loans handled by big mortgage companies are actually owned by an investor. These front companies (such as Wells Fargo, Bank of America, SunTrust, or Chase) are acting as a "servicer."

The servicers save money by taking 60-90 days to consider a short sale offer, turning down files over one missing doc, and cutting staff. So, if they have offers coming in "way under the appraisal value", it is another excuse to just turn down your short sale request!

However, if they can see that the house is valued at 145k and you're selling it for 140k, they'll accept the offer. Again, which is why your agent needs to make sure the appraisal will be more in line with the market values.

Stop Foreclosure: Do I Qualify For A Loan Modification?

Denver, CO - Here is a question we get asked on the first inquiry when requesting our Free Loan Modification Guide! This has to be addressed upfront so that the home owner understands what they are up against asking for a loan modification with their lender!

Our answers are as follows:

Has your income recently been reduced? OR, is your interest rate about to re-set to a level you cannot afford? OR, you have other live changing events as divorce, loss of spouse, etc.

In these cases, you probably could be a candidate for a loan modification. This is true even if you are not yet behind on your payments. This is important to understand. If the person with the lender tells you that you have to be in default, that is NOT THE TRUTH! There are other things to be made aware of, as well.

To start the process, gather up all the necessary documents. You will need income documentation, all your mortgage documents, and copies of your monthly bills. You will need to present the lender a case on why they should accept your loan modification.

In essence, you will be providing a new loan application (financial package) to get a loan modification approved.

You generally qualify for a payment reduction if the house is your primary residence and your payment is more than 31% of your monthly income. Now, keep in mind, if you are drastically beyond that 31%, they may deny the loan mod (payment reduction). WHY? They do not believe you can afford that reduction any more than the original payment. Especially, if you have a missed payment history.

If you are unemployed and behind in payments, they WILL NOT approve a loan modification. You may have to choose another option to avoid or stop a foreclosure!!

One more thing to understand what lenders are doing when working loan modification requests. They may set you up for a "trial period" for 3 months. When you are behind in payments, this trial period is a way for them to collect "back payments" from you!

Many lenders are accepting loan modifications. About 3-5% requests are being approved!! Here is the key. You must show your lender how it is beneficial to them to accept your loan modification.

A Common Denver Short Sale Negotiation Mistake: Talking Too Much


Westminster CO – This is the worst sin of negotiating. Don't tell the buyer's or their agent your life's story.

What do you think would pop into a buyer's head if they heard this out of a seller's mouth? "We must sell the home because it is in foreclosure and if we don't sell it be June 23rd, then the bank will foreclose on it."

Immediately they will think, "I wonder what they owe on the house. If it doesn't sell they will have a foreclosure. The sellers probably just want to get what they owe on the home so they can avoid foreclosure."

This is an extreme example, but it shows you how a simple slip of the tongue could cause a seller to lose a large amount of their hard earned equity.

A seller facing foreclosure in that situation might be desperate enough to "get out" with none of their equity just to avoid foreclosure.

But, what if the buyer was willing to pay the market value for the home? That seller just lost all their equity! When a buyer asks why you are selling answer them without giving away any extra information.

You could say, "Oh, we would like to move to a smaller home." You don't need to say much more than that. And don't tell them you must sell by a certain date to avoid foreclosure!

Westminster Short Sales: My home is in foreclosure. How soon will the bank kick me out?


Westminster CO – The Stop Foreclosure Institute recently received a question from another realtor named Sandy.
Here is her question.
“An agent in my office currently has a listing under contract. It is a short sale, the sad thing is that Large National Bank (to remain unnamed) notified the sellers that they had foreclosed a month ago.

Fact is, they had not foreclosed. The employee didn’t know what they were talking about. Valuable time and a buyer were lost during this fiasco. This deal is currently awaiting approval. There is no telling what will happen in the end.

My question is this. What can we do to track the foreclosures and see when the bank is foreclosing. Sandy.”

Here is the answer to Sandy’s Question. The best way that I have seen to track this is by checking the docket, in most states.

The docket is the record at the courthouse of everything that is happening on a foreclosure. In some states the foreclosure is a court case and you can track the case.

In Colorado, it is the only state that uses Deed of Trusts and Promissory notes instead of mortgages. So the foreclosure process is handled through the local County Public Trustee system. The Deed of Trust gives the Public Trustee the right to start the foreclosure process when a loan is in default.

Short sale brokers can check online or by a phone call to the County Public Trustee, where the property resides in, in order to see the deadline dates of the foreclosure process.

Make sure you hire a short sale broker that is familiar with the foreclosure process in their state. There is NO excuse to not know if a property has gone to “sale” during the foreclosure! Understanding this process can help you negotiate the short sale with the lender(s), in order to avoid foreclosure!
